This is my assumption on it as well. I don't know what the actual rule is with this stuff, but far as I'm concerned the US.gov is her employer. Much the same as any govt employee or elected official.
It should be standard practice that all govt employees/elected/appointed officials should be required to use an "official" govt email.
It's bad judgement to not do this and even if she's on the up and up it just screams that she's trying to hide something. The very fact that she went through the witch hunts with her Husband should make her want to do everything possible to be in the open with this kinda stuff.

Says who? Says only her. They didn't even go email by email to make that determination, just did a search for keywords, and deleted the rest. She lost the right to her only having the say on this, when she broke federal policy and ran both work and private emails together on her own private server.
Could all the emails she deleted be only private in nature? Sure. But we are taking only her word on it.

They are entirely the public record. In fact she worked for the state department, who requested the emails, and the specific emails requested by the state department relate the Benghazi.

You need to distinguish between big L and little l, if you are discussing political parties. One is a political party and the other is a set of ideologies.

You know there are usually more than 2 parties on the ballot? Vote for the other party that is most likely to get the most votes, and maybe they can get enough votes to receive federal funds for the next election. That is a much better choice than not voting at all.

It sounds logical but think about it for a moment. Jeb Bush was governor of Florida, a Republican, and all of his email should be owned by the state of Florida, right? But what happens when a Democrat becomes governor - does the other side suddenly have not only full access to all emails he ever sent out, but also has the legal right to publish them?
Maybe you are right. I mean, Boehner works for the Federal Government, right? And all of those emails are owned by... The Federal Government, RIGHT? And being as Boehner works for the Federal Government ALL official email should go through government servers, and are subject to review and can be published by the White House at any given time.
You see where I am going with this? Obama boy is in office now and should have access to every email ever sent by Bush. That can contain some damaging and embarrassing information for the Republican party. Emails sent by the Republican party should never be in control by the Democratic party unless there is a very valid reason.
You already see what's going on here - they are trolling for something, for anything, with the attempt to embarrass her just like they did with President Clinton and the entire Monica thing.
In the mean time, Hillary did what a lot of other government officials do, ran her own email server, handed over the data, and then wiped the server clean and re-purposed it. At the same time all they are doing is giving Hillary free advertising because her name is in the news all the time.

If anything it gives the appearance of impropriety and shows her bad judgement.
No warrant is required for emails older that 180 days -- just a simple subpoena. Subpoenas require no probable cause -- they are used in discovery of evidence. All the more reason to not commingle your email.

It't not about commingling email. In the normal business world, your predecessor is not going to read every email you ever sent looking for legal issues or embarrassing information. In the political world it's just the opposite - The next Democratic governor of Florida is going to assign staff to go over every email the former Republican governor ever sent with the intention of embarrassing the Republican party. That's just the way politics works.

the state department is already "attacking" hillary over it. that's because this is happening now, it's not happening a year from now.
They would have had to be insane to run Hillary, the democrats seemed totally disconnected about how a large segment of the population feel about her.
Now it's going to be a toad race between two OTHER candidates who don't represent any of my interests and I'm really just on the edge of my chair to see who it will be.
Cruz is, if anything, almost more horrifying except that he will support gun rights and the established immigration laws. I used to be liberal a long time ago but ever since Clinton every single part of the Democrat plank has driven me farther to the right.
But I think everyone can agree that we live in an increasingly disturbing oligarchy. There ARE extreme distinctions between the two parties however and I am not a socialist.
