Max Hardcore had no idea that his sites were on servers located in a Tampa data center - and I believe that. His servers' location was an important part of the government's case against him - they wanted this case in Florida not New York or California.

So how many adult hosting companies have data centers in Bible Belt states?

I moved my sites to Vacares Hosting. I've saved money, my hair is thicker, lost some weight too! Thanks Sly!

I know the city mine is in, but I don't know much on their views on what is considered obscene.

Tampa is not persay part of the bible belt. But it does have a lot in influence.

If you need hosting outside the country, there are plenty of places that do it.

So your server outside USA ( or that sate ) but under a USA corp ( or afffiliation ) comes to the same.

It does not matter where your server is. If your site can be reached from the US then you are targeting American citizens and liable no matter what your citizenship is.

you are serious ... So as a Canadian, content on my server should comply with US ( or Tampa law ).

And does your stuff on your US server have to comply to Canada's law .. or better to China's law...

No way would the goverment have brought that case against Max Hardcore without the evidence of physically mailing the obscene DVD's to a Tampa address.

What hasn't ever been decided yet is whether a website owned by somebody in California can be brought up on obscenity charges in Florida simply because a citizen of Florida can access and download the material from a server owned and located in California.

If I'm wrong - show me the case.

Honestly, and I do agree that it's fucked, but he should have moved to a safe country and sold videos to Europe only and hosted and operated his sites from a safe country as well. Fuck American consumers. If he felt he needed to face fuck and piss in a girls eye socket, he should have done it while living and operating abroad. That includes banking, living, hosting, billing... you name it, and never step foot in the USA again.

Otherwise, take your medicine and go to bed.

I don´t know much about US law regarding this, but let´s assume I shot the same kind of content as Max Hardcore. I am not a US citizen, do not live in the US and let´s say I keep my server somewhere in Europe (NL or wherever).

Could I get in trouble once I step on US soil?

Today: yes.

The americans can arrest anybody on their soil, not charge them, and put them in " special " prisons ... You have no rights to a lawyer, to know the accusations or to see the proof .

On foreign soil, it is well documented that they did kidnap people ( they call it rendition ).

Bottom line: be carefull.

I do not know where you live, but like in most cities, there must be some bad areas ( dangerous, unsafe, etc ..). You avoid them.

I live in South America, never been to the US. I dont produce content, just a regular affiliate.

The results of that trial are complete garbage. But, there's a couple things that can be implemented to "help" avoid what's happening there... If you've got extreme material I'd look at hosting outside of the US as they used the server location to justify their prosecuting in a conservative "community"... Or use clusters or some sort of distributed system so that you have servers around the country/world. Secondly, if you sell your DVDs to a distributor, then have a contract in place that states they must only ship to places where the material is "legal". That will move the onus onto the distributor and "should" have prevented half the charges Max was found quilty of.

Agreed. I would love for America to be the land of the FREE, but apparently FREEDOM lovers feel entitled to their apathy as well.

Another point is that this is not the first time Max has been targeted. If I was in his position I would have shut down the operation after it became very apparent that the gov't was after me, which was years ago. Sure it's nice to stand up for what is right and challenge a system that is bent on removing civil liberties one by one, but there are more productive ways of doing it. Ways that can keep you out of jail. Unless of course you are not actually willing to give up throat fucking and pissing on the daughters of America.
