    70 arrested in Australia in pornography sting

    CNN - SYDNEY, Australia (AP) -- Australian police have arrested 70 people and removed four child victims from homes in a six-month nationwide investigation of a global child pornography network.

    Police said 20 other people have been summoned to appear in court. The 90 face charges of accessing child abuse images on the Internet.

    Australian Federal Police Commissioner Mick Keelty said Thursday the investigation was conducted simultaneously by law enforcement authorities in 170 countries. Further arrests are expected.

    The maximum penalty for possessing child pornography is 10 years imprisonment.

                                                                                                  First off, do you realize that for the police and media, anyone will be referred to as a kid up to the second before they turn 18? "Sex acts with kids" can refer to a 50 year old raping his 2 year old stepdaughter, or a 19 year old having sex with his 17 year old girlfriend.

                                                                                                  Obviously, the two are rather different. In the press release, though, they will both be referred to as "sex acts with children".

                                                                                                  That's why it's so fucking stupid to demand high minimum sentences without knowing the details. With a 10 year minimum sentence, the people who download a homemade video of a 17 year old girl giving head to her 18 year old boyfriend without even knowing the girl is 3 months younger than the law allows will also get that minimum sentence.

                                                                                                  Likewise, the person who stumbles upon some of the really bad stuff, thinks "what the hell?!", and clicks it in disbelief - in the same way that people might look at trainwrecks, car wrecks, 2girls1cup, etc.

                                                                                                  Likewise, the person who downloads all files labeled "teen porn" or whatever on emule or limewire or whatever it is they use these days, and finds out that, in fact, "teen" also covers "thirteen".

                                                                                                  Those are not technicalities. None of the people I mentioned should spend 10 years in prison.

                                                                                                  And guess what? There's a good chance that some of the examples I just gave will turn out to be the case for some of the people arrested in these raids.

                                                                                                  To summarize: demanding specific punishments without knowing the specific details of each case is very fucking dumb.

                                                                                                  Idiots just like you tend to wreck lives by screwing up the legal system with insanely broad laws that end up harming the wrong people.

                                                                                                              You fail to see the link between someone getting a ridiculous 10 year sentence because that's the mandatory minimum, a minimum which was most likely inspired by the general outrage that the very words "sex" and "children" cause when put together, and someone crying out for a mandatory minimum of 10 years regarding a crime, outraged by the fact that there are both children and sex involved?

                                                                                                              Child abusers, child rapists, cp producers, cp traders, etc. should all be thrown in prison for the rest of their lives. I think we can all agree on that.

                                                                                                              The 18 year old guy who downloads a self-shot picture of a naked 17 year old girl while believing the girl is over 18 should probably not be sent to prison at all. I think most of us will agree on that, too.

                                                                                                              In between those two extremes, there are many different cases. The cases which might technically be said to involve "child pornography" but which in reality lay closer to the second example than to the first are a very good reason why minimum sentences are a bad idea, and why being outraged without knowing the actual details is less than productive.

                                                                                                              Just recently, I read about a girl who got charged with production of child pornography. She had taken pictures of herself, and had posted those online - while being under 18. That example alone should make it rather clear why it's pretty much a smart idea to get to know the details of a case before even thinking about appropriate sentencing.

                                                                                                                                                              A policeman, four Queensland teachers and a West Australian sports administrator were among those arrested or summonsed in Australia as a result of the six-month operation.

                                                                                                                                                                      Am I defending child rapists by saying child rapists and child pornographers should spend the rest of their lives in prison? Or am I defending them by pointing out that not everyone who at some time comes across a naked girl under the age of 18 is a pedophile, child rapist or child pornographer?

                                                                                                                                                                      Your idea to institute mandatory minimum sentences is a bad idea not because those who rape children on a daily basis should not be locked up in a doorless cell, but because mandatory minimum sentences would also hit the ones who, for example, come across a naked 17 year old on a message board.

                                                                                                                                                                      Judges and juries recognize the difference between a 50 year old raping a 6 year old and an 18 year old dating a 16 year old. Likewise, they recognize the difference between someone who has thousands of hardcore child pornography pictures on his hard drive, and someone who has thousands of amateur nudes on his hard drive, one of which happens to be of a 17 year old, while the rest all feature adults.

                                                                                                                                                                      Mandatory minimum sentences make it impossible for sentencing to reflect these obvious differences.

False arrests can and do happen, and while some of the people arrested undoubtedly are scum of the worst sort, it is quite possible that others will turn out not to be pedophiles at all.

Mainly because the worse the crime is, the more likely media and the public are to come to a conviction of their own, regardless of evidence.
