How Come Tubes Are Allowed to Show Stolen Content

I am guessing this has been asked about a million times but I don't run tubes and I have very few dealings with them.

Anyway. Why is it that a tube can show content blatantly stolen from 1000s of paysites?

I know it's not the same but I have had a few dicks try to steal my content and a letter to the webhost usually gets their account canned in 48 hours.

Why are tubes above this.

Tube sites make it very easy for anyone to upload content, and do nothing to verify who might own that content. If no one claims the content was illegally obtained, Tube sites are under no legal obligation to remove it.

It therefore becomes the burden of the actual owner of the content to file a claim, and, that claim must be a properly worded and formatted claim which includes things such as the full name of the owner, links to stolen content, and especially legal proof of ownership of that content. This is not that hard to do but can be scary and time consuming to the true owner of that content.

The tube site is not legally required to respond to any request that is not submitted properly.

When a request is properly submitted, the tube site can take a reasonable amount of time to respond, if at all. If they do not respond, the owner can then go after the hosting company which again requires some properly formatted requests.

All of this takes time of course which means that the tube site owner can profit from stolen videos until legally required to take them down. This does not prevent someone else from uploading the same content to the same tube site again, forcing the content owner to go through all of the legal steps once again to have the very same content removed.

If I find a site using my content I contact their web host first. I will not contact the site because frequently they will never reply.

Yes, I have to submit a form (do not all hosts have such a form?). The form requests my details and details of offending content and proof of my content. This is usually as simple as saying I own full rights to said content.

After submitting a form to a web host I normally get a reply within 24 hours and content is removed within 2-5 days.

Of course a user can re-upload the content again but the previous user should be banned so the same account can not upload the same files.

So is it because property owners do not work hard enough to DMCA or is it the Tubes that don't?
Or do neither?

I was just on one called large cam tube and there was a girl that looked decidedly underage.

But if the tube site is not in the US then the DMCA doesn't even really apply. Some follow it simply to humor you.

Anyway the real answer is basically:

"Because they own the industry now"

That is called a repeat infringer policy. Most adult tubes effectively do not have one. People used to try to get Fabian the old Manwin "owner" to have a repeat infringer policy like Youtube's 3 strikes but he always seemed to dance around it.

Again, the DMCA has no teeth and these guys pretty much own the industry now. That about sums it up.

I am all for legal tubes. Banner or sponsor link under the video etc but tubes that just have these stolen / illegal / underage? content.

Why does no-one do anything? I know AK tries but it seems like he is pissing in the wind. Surely there must be a more effective method.

I've asked the same questions starting back in 2007. It's just the way the industry is. And secretly all along most of the major players in adult owned tubes way back. They kept it a secret. Everyone simply scratches each other's back now. You're the asshole now for saying something. It would make a great book and case study for the decline of an industry and how the choices of industry participants impact total earnings of the industry as a whole but blah. Broken record.

You see a lot of this lately. After stealing content for years, owners are now teaming up with tubes for a cut of the action.

Tubes are a great model and if done right could have been a great thing instead of a pool of stolen content. Nothing lasts forever and it was a stupid move to cut out the supplier but as it turns out, many supplies don't care about that and are now willing to do business with the same people who fucked them for years.

Legitimate tubes owners will have a very tough time competing against the ones who are posting thousands of stolen full-length videos.
