I cannot comment on 1 and 2 but I can on #3. I know the owners of a tube site - I actually had a lot to do with the tube scene - and I can say that they're not exiting by any means. There is a lot of long term thought put into it. The paysite model is in jeopardy and it is a good idea to look into other means of monetizing porn. For some that means tubes.
If I were to start at zero again I would not look into a paysite by any means. The internet as a whole is changing and this time the adult biz is not the catalyst. The adult biz is not even playing catch up! The tubes are jumping on the bad-wagon while everyone else is grasping at yesterday.
Go ahead and sue the tubes. Win even. It will change very little about the state of the net and adult's place in it.
