I had just seen Shap's earlier post about Twisty's public redTube stance. As far as I'm aware, only AFF is currently a target, perhaps because BrazBucks is not domestic. I'm not sure, but I'm sure someone else could drag them into if you wanted to, and if I owned content appearing on RedTube, you know I'd be sending a copy of my DMCA to [email protected] everytime, just in case.

YouTube and Google already make efforts to control copyrighted material without requiring a complaint, they respond automatically to DMCAs BEFORE investigation, terminate user accounts when they discover infringement.

I think google could quite adequately make the case that their business practices are fundamentally different than redTube, anyone agree?

That is actually not them. From what I've heard it's a complicated story and dates back to when they were in bankruptcy. Bottomline is that stock has absolutely nothing to do with Penthouse, AFF or GMCI.

              I'm glad you think so.

Listen, I saw some people hating on you in your thread, and I personally disagree with the decisions you are making, however I want people to keep something in mind.

There are a LOT of stakeholders in this Tube issue, and AFF, BrazBucks, Twisty's and the like, find themselves in an odd position. They are uncomfortable with the new format and behavior of new sites, and they are asked to formulate a position, to make a decision on the spot about an issue they really didn't create.

I don't forget that the reason you are put in this position in the first place, is because certain tube sites willfully engage in this behavior that is detrimental to your business and the industry, but because of the smoke and mirrors of technology, people think this is like when radio made music free in some capacity. But, it's not, this is outright content theft, in a player. They control it, it's play on demand, and on many of these sites it's available for full HQ download.

It's just Theft, but they are using scare tactics to convince owners that They are the future.

The technology is part of the future, but the tech developers that think they can survive in the world by expecting the laws to be re-written as they see fit to their business model, they my friends, will not be part of the future.

At least without themselves adapting, probably more so than the law does.

Cool. I bring that up because my stance and what I do is very different from many other companies. I understand people think I'm just as bad but there is a very big difference. My banners appear next to my content and nowhere else. I don't have my banners plastered across the sites the way many other companies have. I've also been very open about it and any sponsor that needs help getting content removed from those sites I am more than happy to do what I can to get their content removed. Even if it means terminating the affiliate.

                      From wikipedia:
Penthouse?s parent company became General Media Inc in 1993 in connection with the company going public in December 21, 1993, in an $85 million United States Securities and Exchange Commission (SEC) registered bond offering. Jefferies and Company led the junk bond offering (Jefferies is a leading middle-market investment bank listed on the New York Stock Exchange). The main buyer of the bonds was the $40 billion MacKay Shields division of the venerable $143 billion New York Life insurance company.

I am not certain of Penthouse's corporate structuring, but they were at least AT ONE POINT, public. I don't know what happened to them, because there are paragraphs below that saying that those brands and assets have changed hands several times.

They were public. But have been private for the last few years. Everything changed when they went thru bankruptcy.

WTF are you talking about, AFF (dating) and Cams (webcams) single handedly monitized all of the orginal and most popular tube sites.

Odd postion maybe Twistys and Brazzers since the stuff they are producing is also getting stolen, but AFF??? you have to be joking, AFF isn't in an odd position. They are in the perfect position to kill the competition and make money off of traffic which is being generated from other people's stolen content.

I'm with you there, AFF must have been a brain fart or a typo.

And what of RealityKings, content provider with a dating site.

BTW, I have noticed I can't find any of RedTube's sponsor's videos on redTube.

Does this mean they have the ability to control infringement of material and are willfully choosing not to do so, unless you pay them. mmm could be court fodder too.

Has AFF said ANYTHING on the isse?

BTW, we'd like to drop AFF for their behavior, and Pichunter makes 17K a month with them, any dating or cam sites that have a stance against supporting infringemet?

Fling and AFF are out, anyone on the up and up right now, I'll drop them a nice account.

Ok so someone decided to spend alot of money to fight the good fight....but they're still going to lose.

It sucks but that's the way it is.

This is like suing Budweiser because they sponsored the Super Bowl where Janet Jackson's nipple was exposed...so that makes them a party to your mental anguish.

                                      Slippery slope.

                                        Slippery slope.
How do you know they are going to lose? Did you practice law before you got into adult? Whoever is doing this isnt the only one Fred Goldman is going the same route with BT's. All it takes is one win to set precedent.

I think google could quite adequately make the case that their business practices are fundamentally different than redTube, anyone agree?
How much stolen content is really on google? real stolen content from a site's members area? Or in mainstream terms, a full length hollywood movie for example.

I love how people compare youtube to illegal porn tubes. Illegal porn tubes are 98% stolen content 2% real. They only exists because of stolen content.

Everyone keeps telling me I am wasting my time bitching about AFF and their tactics and that no one listens. If you drop them and they lose a 200K a year account, that would be awesome. You top notch in my book.

I'm not convinced it will work, but would like it to. The problem I have is 100s of people directly profit off stolen content. Go to Torrentspy and see Paypal making money off processing for the paid downloads.

Look on any illegal site and you'll find adverts supporting the site, have the software, music and film industry missed this excellent way to sue the infringer's advertisers?

Would be nice to see if it works but I think it might hinge on how well people respond to a DMCA notice. Might work if the illegal site refuses to adhere to a DMCA on the grounds they are not in the US. But they have US advertisers.

In any case it took the lawyers a long time to find this loop hole and why not Perfect 10s lawyers?

                                                        Will wait and see.

It's more like their ad leads in to the infringment, leads out the infringment, and is prominently displayed on a site that has more infringing material than not.

Dood...to be fair to Shap. He was just trying to make a descicion to try to deal with a problem that wasn't going anywhere and trying to control it, by tying the finacially to twistys.

Last I checked most people's parents don't know how to use torrents, but, I htink they all can use YouTube. Look, there's a difference between bootlegging occurring in a city back alley, vs. a store in the mall.

If users keep having to run to all new mediums and learn all new shit, on illegal sites that keep getting closed. I think they will tire of that shit and pay $24.99 for thousands of videos that aren't much of a hassle. At least, my target consumers will, c'mon, day job, 50K a year, and you wanna fuck with torrents, ftps, mirc, and not just pay, then you weren't ever gunna pay, and if I took away all the porn, you'd jerk for free still, using your thoughts.

Hardcore freebies will always find that shit, but they weren't going to pay anyhow, or don't have the capacity to, or they are under 18. For the most part.

But, I can't just search google, for "Free Metallica" and get it easy. Not like the old days, so you can miss my larger point all you want, but you know it's not like napster was. It's better, if your a tech nerd and shit, but a plain old comp user, it's hard to keep up, and increasingly easy (and worth it) to pay
