"did he threaten you as you attempted to go home" etc. The answer is "no", "no", "no" .... you can't argue you pre-emptively attacked someone because you felt threatened without having cause to feel your life/body was in imminent danger. Being followed by someone who is clearly on the phone is not cause to attack them.
