It's obvious he used your site as the inspiration for his, but the only thing that remains exactly the same is the background colour.

I don't think you could sue and win, because he's made too many changes.

Yours looks 10 times better anyway.

Those 2 sites look nothing alike. They have the same style of layout but are for sure different. I have seen about 3000 sites that have this same color setup and layout.

Even if they copied the layout of your site their is nothing you can do about it. At that the quality of your site is much higher so why even waist money on a lawyer?

You might be able to get them onthe combination of the clearly over-similar name and similar look...

If I had a red and yellow burger joint with a giant W for a logo, and called it MacGregor's, my ass would be grass. Even if it isn't outright copying, you can get them for clearly aping your material.

With all the legal implications, what webmaster in his right mind would buy content from someone he doesn't know, or someone without impecible references. Nothing like laying down 2 grand on content then discovering down the road that your license is worthless because the license isn't really with the real picture owners or the proper model paperwork doesn't exist. Or worse yet, you are hauled in front of a judge on charges of child porn and discover you are totally fucked because low and behold one of the models was under 18.

www.adultcontent.ca, now them I've heard of - their pros.

A site like this opens and closes every week on the net. Prpbably only did it so he could get some blow jobs.

Hmmm. I'm interested in knowing where that came from. I'm sure that that is not the actual law, but are you referring to some precident that I haven't heard of? I find it hard to believe that there is some sort of "10% rule". When is one website 10% different than another? - absolutely impossible to measure quantitatively I would think. Sounds like an internet myth to me.

They do look somewhat similar. But do you have any idea how many sites are out there? fuck... there are millions and millions on google alone. You dont think you'll come across one or 2 that look like yours?

Design is great, it's what you do with it that matters. We get enough crap from surfers much less other webmasters wanting to sue over something like this.

Most people who have tried to give you advice have wrongly focused soley on the design similarities. If it were just the design similarities and the guy was on a non-adult domain name running a bookstore, you wouldn't have much of a claim.

However, the copyist is operating in the same segment of the same industry as you, and is very obviously trying to profit at your expense from the business and reputation you have built by mimicing your site.

All of you people advising against suing, here is an experiment for you to try. Put up a site about online auctions which looks remotely similar to EBays site and has a similar domain name, then see how long it takes before the C&D letters begin arriving.

I learned this from my Ex's stepfather, a sucessful tort lawyer, who said something like the following to me while we were discussing a case: Even when the letter of the law isn't clearly on your side, you can predict your level of sucess 95% of the time if you can accurately discern the ease with which an objective observer can be persuaded to infer nefarious intent on the part of the defendent.
