advice needed - shooting own content

I want to start shooting my own content, nothing too professional, just Amature.
Can someone please give me advice on shooting own content?

What are the legal issues? do i just need 2 pieces of state id stating they are 18+? and a model's release form? where can i get that form?

Where kind of questions do you ask the models in the interview?
Would it be ok to shoot in a motel/hotel?

How did you guys learn all about it?
Is there some links about explaining how to shoot your own content? Or how can i learn more about it? hire professionals and watch how they do it? or like did you guys learn from reading books or internet resources?

Any advice would be greatly appreciated.

    Thank you

Most people would say 'hire a good adult industry lawyer'. I hate lawyers so I tend to do my own legal homework...but as a disclaimer - I am totally not a lawyer so my ways of getting the job done could be totally fucked.

Read up on 2257. Don't even think about shooting someone under the age of 18 no matter how much clothing they are wearing. ---then you definitely need a good lawyer to keep you out of trouble.

There are tons of samples of model releases for adult content on the web. Just look around for them (= Google: "adult model release"). Look at a bunch and add all the clauses that you can together that make sense for you...if you need more help to understand what clauses are relevant then maybe you do need a lawyer.

Make sure you tell your models what you are trying to get out of the shoot and make sure the model release reflects that purpose. My releases usually have a paragraph that says "Purpose of Shoot: Erotic images for adult website use. "

Ahh shooting in hotels ...I do this quite a bit. I have heard varying opinions on doing a hotel shoot without permission. I think about the issue the same way I think about model releases (but I am probably wrong) - if you shoot in a hotel room then what you are doing seems to be an act in the privacy of your own room and as long as nothing in your photographs would allow someone to recognize that you were staying at the Marriott then you should be ok...but if you shoot a shot with a copy of the room service menu and a Marriott logo on the cover then you are violating. The big flaw in this reasoning is that by taking pics in a room you are conducting business in the room...I'm not sure what the rules are on that.

Not sure what you mean by interviewing the models...I mean do you really care what they think? You just want to know if they can look good for the camera...I find that the worst adult models are the ones who are really confident about their modeling capabilities. The best can be the shy girls who you get to relax and show you a part of them that they never even knew they had. ...and that, not technical photo capability, is what makes a great photographer of amateurs.

well, technically in NY shooting in the hotels is illegal, as I am sure it is in one form or another in most places, or at least against hotel rules, but people do it all the time so it is your judgement call.

As far as interviewing the girls, i assume you mean interviewing them to get them to shoot with you and not interviewing them on cam once they decide to shoot with you. This is tricky, in a lot of locations this could be construed as pandering, and that comes with a sex offender rap i believe. If you work with models in the biz this is not an issue, but trying to get a girl outside of the biz into shooting is walking a slippery slope, especially outside of Cali.

As far as how to learn to shoot, I would just suggest putting the cam in your hands and practice for a month or two before spending any money on models, just to get used to being nice and steady. If you are going for an amatuer look then i wouldn't worry about how professional my shoot looked, it all adds to the ambiance. I would DEFINITELY suggest doing some kind of test shoot, then going and trying to edit to see exactly what you did wrong in shooting so that you know what to do next time, that helped me out a lot.

Yes i did mean interviewing them to get them to shoot with me.

Your saying that just interviewing them to shoot with me could be considered as pandering? or u mean that only for interviewing them on cam? or is it both?

How can i find all about the laws about shooting content in nyc? like is there a specific place which gives this kind of info?

Would a adult industry lawyer give me all the guidelines on how to do this correctly and not break any laws? Any ideas how much they charge?

at the end of the day, you are going to try and talk a woman into committing a sex act and money will be exchanged. Now everywhere outside of LA porn is a gray area except for a few places that it is outright illegal. The reason it is gray is because it has only been challenged and won in the state of California, and other states if brought the same issue could go along with what California thinks or they could interpret the law a different way. I think in NYC they would side on porn being legal the same way they did in cali based on a comment a ny supreme court judge made when tossing an arguement a NY madame made about porn being shot in NY and not being penalized where the judge rightfully stated that in porn money is given to two people by a third party to perform a sex act for the third party to film for sale as entertainment and therefore is not prostitution.

Now, having said all that, walking up to a civilian and trying to get her to do sex acts for some form of payment could be construed as pandering and you can get into trouble for it. I think most people recommend trying to gradually work the girl into it by maybe just shooting some solo nude stuff first, and kinda tiptoe around the hardcore issue and guage her interest there. Kinda put it on her to bring up by asking what her limits where in shooting adult erotic type content.

          Where are you located?

As for lawyers, I don't think there are very many outside of NY and Florida who are very well versed in this stuff, most of the adult lawyers not in those states deal more with strip clubs which is totally different from what we do. Try here adultbizlaw com

            tcsfounder -

            I live in NYC.

i will not recruit Models on the streets. I will do it online through a website. I am focusing on Girl On Girl Softcore Non-Nude, but once in a while have a tit slip here and there, so there is no sex, just kissing, touching etc... So am i ok? this is not pandering right?

So basically i need to learn all about 2257, Model release form, make sure they have 2 State ids stating they are 18+...is there anything else?

i tried google didnt find much, probably not searching the right keywords...i wish they had a tutorial on how to shoot content and the laws...

if anyone who has knowledge in this field can teach me all i need to know about this kind of stuff...hit me up...i'll pay for your time..

            Thanks

Want some real advice, take a look at the top performing pornstars, what do they all have in common and what attributes make them worth paying someone to fuck on camera? Remember, "Quality" not "Quantity."

By the way, Make sure you Jizz on her face!

No, but I constantly "screen" porn to put on my website: speedwacker.com and I have to make sure that the quality is strong enough to retain my visitors and cliental and attract new visitors...this is known as stickyness.

I got a degree in Marketing with a focus on Internet Marketing. So far I've gotten over 50,000 visitors to my site since December 27th, with only spending 140 dollars in advertising. I pay less than 1 cent per visitor to my site.

I've also ready over 30 books on Internet Marketing and been involved in several startups, as well as reading several books on business strategy, policy, marketing strategy, operations management, finance and etc. and I intend to exploit capitalism to my advantage and I felt like making fun of your post cause thats the way that I am. By the way, what do you plan on doing with your content once you make it? How are you going to capitalize on it?

And I hope that you really do have a "plan" not just an idea in your head that your going to do a whole bunch of shit and it'll convert into money, especially since your competing with a million other motherfuckers with cameras and cheap whores that they post on the net.

You really want to make it happen it takes more than posting shit on forums, hit me up and we can discuss if you're for real. People that put up real money, blood, sweat, tears make the money. The little boys that never put money into their projects go nowhere. That's why there so many failures. Even the "big dogs" of the industry get hit hard sometimes. Take a look at redtube.com they got hit hard with a group of hackers and their site is down.

i have the $$ to put out some good quality porn and contacts to some really good porn directors...but since im new, ...$2000-3000 per scene is crazy..i dont want to risk my money

i want to start by producing my own content rather then buying saturated shit...i do have a plan...and by me making my own content it will be really cheap...so even if i lose out it wont be that much.. it will also be a good experience.... im just mainly concerned about the laws...

i read read this at en.allexperts.com/q/Adult-Film-2706/2008/1/Adult-Websites.htm

                                  Question
Hey Jim, I was thinking about starting a website for amateur porn. I would be charging a monthly fee to view the content. I know you are suppose to technically shoot all material in CA. I know alot of porn stars and sites do not follow this rule. so my question is is there anyway of finding out if your the scene has been filmed outside of CA and are the consequences serious. And as long as i get my people tested everyone month and have 2 proofs of identification stating that they are of age and have them sign there release form do i necessarily need a lawyer? Are there any other steps you would warn me of?

                                  Answer
First off don’t confuse yourself by thinking the laws regarding Production outside of California are mealy a “technicality” because they most certainly are not. Yes it is a serious matter and yes it carries serious penalties. No matter how you twist it, production outside of the State of California is a crime.

How serious are the consequences if you are caught? Well, not real bad…IF you don’t mind being charged with a variety of felonies, forfeiture of all your production equipment, forfeiture of all money made from your previous productions, jail time for your performers, and spending at least the next couple of years in prison.

Is this really true? so basically shooting outside of CA is illegal?

what if im only shooting Girl On Girl Softcore Non-Nude, but once in a while have a tit slip here and there, so there is no sex, just kissing, touching etc... would this be ok? or is this illegal too?

what should i do? get a adult lawyer? can someone recommend a good one?

Yeah, there are a few lawyers that can help you with this, they charge like 1400 dollars per hour with a huge retainer of like 10 grand, because they are Internet marketing/technology lawyers:

There also large amounts of content already created that you can use.

                                    Everything must be 2257 compliant!!!

                                    Also check these guys: http://www.adultwebsitelawyer.com/

Here's the law that you need to understand and go by:

One more thing, if there under 18, make sure the camera is off and no other recording device is in the room...just looking out for the newbies.

                                        Answer
First off don?t confuse yourself by thinking the laws regarding Production outside of California are mealy a ?technicality? because they most certainly are not. Yes it is a serious matter and yes it carries serious penalties. No matter how you twist it, production outside of the State of California is a crime.

How serious are the consequences if you are caught? Well, not real bad?IF you don?t mind being charged with a variety of felonies, forfeiture of all your production equipment, forfeiture of all money made from your previous productions, jail time for your performers, and spending at least the next couple of years in prison.

Is this really true? so basically shooting outside of CA is illegal?

what if im only shooting Girl On Girl Softcore Non-Nude, but once in a while have a tit slip here and there, so there is no sex, just kissing, touching etc... would this be ok? or is this illegal too?

what should i do? get a adult lawyer? can someone recommend a good one?
no this is not exactly true. The real story is that California is a state where this issue was already brought to the courts and set precedent. There are a few counties in the country where porn is outright illegal, but for the most part it is a case of the issue not being brought up and fought to set precedent like in California, so it is a gray area, and not completely outright illegal.

Also, i read the link you provided, and i would be suspect of taking advice from a lawyer who did not know the difference between the word president and precedent, but that may just be me being a stickler for the english language, i am sure most law schools aren't so strict on stuff like that, lol.

some interesting things when googling around,

it appears the nyc nypd movie/tv unit worked with porn productions until the Guliani election.

new york supreme court Justice Budd G. Goodman issued a ruling rejecting a claim that porn was a form of prostitution. Justice Goodman "has enunciated the legal distinction between prostitution and paying someone to participate in sexual activity to make a pornographic film," the New York Law Journal reports:

Prostitution, as traditionally defined, requires person A paying person B for sexual activity to be performed on A, Supreme Court Justice Budd G. Goodman wrote in People v. Paulino, 6687/04.

Pornography, on the other hand, involves person C paying B for sexual activity performed on A.

There also large amounts of content already created that you can use.

wow pretty expensive for the lawyers...im sure i can ask all the questions i have in 1 hour...but the 10 grand retainer is crazy...i'll try to find someone who doesnt require the retainer i guess or get some advice from some nice people already in the biz and do my own homework...im doing softcore so i think i will be ok...

i tried looking for content, for exclusive content in usa from a known director is like 2000-3000 per scene( its top quality stuff so its worth it)..even getting exclusive content from like Russia is like 1200 per scene...since im a newbie...i'd rather take the route of getting content made myself... if you know any good custom content providers that have decent prices please let me know.

                                          and thanks for the tips

Well, either a US drivers license or US passport is required, both would be great but at least one is required. The second can be a college id or something like that, ssn card works too.

in the past people used a 3rd party address, like a lawyers office, but 2-3 years ago the laws changed, you need to put one of your addresses, either an office or your home. My suggestion is find the cheapest office space you can, there really is no way around it.

some whores in a motel, is highly saturated content, maybe if you dress them in pink monkeys, that might be interesting, I;ve never seen something like that, I can recommend you some offshore studios, but quality content still costs.

                                                              advice

My advice to you is to get a fucking lawyer = professional advice. Don't risk your freedom just to save a few bucks.

I found this guy in Miami...he seems to know his shit:

It's worth it to spend $ upfront to make sure that you're doing everything above board. JAIL blows!!

                                                              Good luck!
