Well, first of all we don't know what exactly happened or didn't happen, the owners of youporn are good at playing hide and seek and managed to stay almost anonymous.

Second, it could be possible that youtube simply didn't want to give them even more news exposure with a lawsuit. This doesn't mean facebook handle it this way, too.

Most important: Youporn did never mention anything about youtube on their site. The colors, layout, all different. They stole the idea and concept, not the look (=trade dress). Your header looks like you copied it from facebook and just badly photoshopped out the "book" and replaced it with "porno". The look and feel is very similar to the original and you even mention "Facebook porn" in the footer.

If something gets traffic, it get's copied, but the way you do it makes a huge difference...that's what everybody tries to tell you. It's like music, but instead of making a similar, but different song, you created a cover version.
