Switch the words swap meet to pawnshop and watch how the law suddenly changes. Tube sites are not swap meets. Tube sites hide behind a small loophole that if they can say "it is to hard for us to patrol what users upload" then you are not legally responsible for the time being of having the content up there on the first warning.
I know people think this industry is just about keyboard warriors and threats. Personally I can give a rats ass about those thoughts. Laws will change, hope you are ready to evolve or die just as well. Specially if either your loophole vanishes or that if by some chance you are required by law to keep a verified list of everyone that uploads material to your site so that the rightful owners can go after the thieves.
