If I read what he wrote before correctly, which I'm sure I did, he clearly states that if they police their own content, they're 100% responsible for any missed verifications, and therefore are leaving themselves in a "gaping" position legally.
They MUST ignore what gets uploaded, or face the full force of the law.

Could be a US company operating out of Canada. Also, knowing the power your government has over us, I'm not surprised though.
Recently the US owed Canada like $6bln from a softwood lumber deal, and refused to pay. They went to court, were told to pay, wouldn't. We then escalated to the highest court, they told the US they had to pay, they said - hell no.
We then took like $2.5bln of the $6 and "settled" or something to that effect.
It's only logical for a large company in Canada to be in bed with US laws unfortunately.
I'm not making any excuses here for them either, just trying to understand their decisions.Comment

If you make people sign up before they can upload anything, and you make them check a box that they have the rights to upload what they're uploading, then all you need to do when you get a DMCA is prosecute the uploader who's account was approved. Do you work in this fashion?
I briefly looked, but I didnt see where you can upload. But I know this is how mainstream sites work. You have to confirm that you have the rights to distribute the content.
Now if you do work in this fashion, then your legal team who said you CAN'T police your own site are full of shit. Fire them.
Your MEMBERS are uploading, and your members are the ones claiming they have the right to do so. So sue your members. Why is this hard?

The vid is just under 2 minutes long, which means it was probably merged together from the clips of 2 of your promo FHGs. There's a "user suggested link" with a 120x60 banner right next to the description of the video ("sweet asian lacey sucking a big sausage pizza") pointing at a nats linkcode (user "sexygirlschannel")...
This is how webmasters use tube sites to drive traffic to the tour. My biggest problem with xtube though is how the description and user suggested link are underneath their sold banner and etology spot... I'd be happier with their site if that box was higher up and directly under the video.Comment

Policing the site makes you responsible for the content, even if you did not put it there.
If it were so easy to sue just for it appearing on the site, there would be too many suits to stay in business. The fact remains that the copyright laws include provisions for safe harbor as well as fair use.
I have read this law, and I have dealt with many lawyers on this topic. I completely understand the theft argument and I am only here to point out how XTube is working within this legal landscape. I do not hate anyone on here and I would not go punching people out at a show for their business practices - whether or not I understood them.Comment

And giving content theives a platform to distribute the content that they have stolen makes you just as guilty as the person who stole it in the first place.
