That article mentions a US law that forbids the killing of US nationals in other countries.
And there's an Executive order banning assassination.
They're legal hedge is that the attack can be made under the assumption that the "target" is an imminent threat to the US.
It does not have to be a call made by the president. It can be made by any high ranking member of government whatever that means.
They do not have to have any proof of the targets threats, of how, when, why the target may or may not propose a risk.
