Was it inside a bank or at one of those little atms, I heard several stories where cards can get cloned at little atms and they also can get your pin number that way...

sorry to hear about that quiet, but same thing happened to my parent's M.C. Somebody made unauthorized purchases worth of $3k at some electronic store. After alot of calls, and lots of wasted time, the funds were recovered. Funny thing is that the purchase had 10 installments of $300 each month and those scam bastards thought it won't be noticable.

quiet - in your situation, can you see the transactions in your accounts' histories?

If the Bank in question is not giving you satisfactory answers and/or results, then you can take some additional steps to put pressure on them. Here are some thoughts.

First of all, demand documentation. Get copies of everything.

Second, make sure to speak to a superior if you do not get results.

Third, the previous posts were good. Take your lawyer and accountant with you.

Fourth, when you talk to the Bank, and after you get to the bottom of what happened (preferably using legal counsel to assist you and protect your rights), if it is revealed that ATM machines were used to rob you, tell the Bank that you want copies of all video tapes and pictures taken at each of the corresponding ATM machines at the exact times of the transactions in question. They will give you a very hard time with this information, but what you can do is tell them that if they don't that you will put the respective state and national banking authority on notice that they refused. If they tell you that the video machines and cameras were not operational, then tell them that you will put their insurance carrier on notice that they informed you that they do not have operational security surveillance equipment. That, in and of itself, most likely will cause a major headache for the bank, and will cause the powers that be to take notice.

scary...... how the hell do they know the card belonged to you? They don't. Anyone can sign anything.... if they don't check it against a photo, it's just asking for trouble..... I've had this happen to me too eRock.... it's sad, and it makes you wanna smack 'em, but it happens....

That explains it all, the way I see it, is that you like to brag about how much money you have, the person that did that must of knew about you're cash you had in you're accounts & he/she fucked you over. Simple as 123... Keep it confidential, nobody needs to know how much you make or have...

                    Important point!!!!

Was the ATM you used in NYC a REAL atm?
One thing, I forgot this last detail: the Biz Markie will always prevail.

yeah .... there was a HUGE ring of that CLONING that was busted last year or so in Toronto ....

all of the guys nabbed worked in PETRO CANADA gas stations ...
                      anybody else remember this ??

Anyways ... they said that a debit card can be very easily cloned by swiping it through a POS terminal that has been altered to actually grab a copy of your magnetic strip ...

That info can be laid out on a BLANK CARD ... and if they had a hidden camera above the handset that logged your pin # .... they were in business ....

                      FUKK THAT SUCKS !!

I have always been very careful to cover the keypad while typing in my pin ever since I heard about that

thanks for all the responses. since some of you wanted me to let you know what's happening, here's a quick update:

i still don't know (because they don't know) what happened. they're now saying it's likely a forged id of myself, used to get a new card from the bank. looks like a total of around 25K taken out over 3 days. this is because in addition to ATM withdrawls, there were other withdrawls from Toronto (somewhere i've never been other than the airport) taken out from a fucking bank teller lol.

it did take a little pressure (mainly me saying i'm pulling everything now if i don't get assurances), but not that much. they've agreed to credit me with all the bogus transactions. they have a corporate security dept that has to finish the investigation first, but i've already been assured i will get everything back.

all the accounts have been frozen, all the assets pulled out of them - and everything has been placed in all new accounts. there is a fraud warning if anyone tries to access anything of mine. i have my large accounts locked so that they can only be accessed from my home branch.

my next step is to contact the credit bureau and put a stop on any type of credit taken out in my name. and wait for the fraud investigation to conclude. fun stuff

the large transactions were all done with a bank teller. under a grand at the atms - 2, 3 or 4 k at the teller.

I'm sorry to hear that, quiet I can only imagine what a hassle it is. I'm glad that it sounds like you'll be getting all of your money back though! I think I would have had a heart attack if that happened to me, considering I have 2 downpayments coming due very soon!

Yeah...I think people are TOO paranoid about online credit card shenanigans. Intercepting a credit card number between point A (customer) and point B (online merchant) is not as easy as simply copying down a customer's number in the back room of a restaurant or retail store. People who lose sleep over using their card to buy a book from Amazon.com will gleefully hand it over to some minimum wage 17 year old in a coffee shop. Go figure.

And, yes, I know this thread is mostly NOT about online fraud. It just brought this to mind in a free association kind of way.

                                                    Quiet,
Sorry to hear that, it's always a bitch to have to prove that you didn't authorize it - nor give anyone your NIP.

Just to let you know, your bank should have advised you of the 'funny' transactions the next morning as they get a report of every ATM that is used, so if one is in Toronto at 8:00 am, you couldn't be in Vancouver at 8:30 am. They get a listing of every transaction in every account, if it's over $ 1000.00 it gets highlighted. So your bankers are not doing their job.

For the person asking how they can manage to get over $2000.00 simple - if you have an ATM limit of $ 1000.00 and a purchase limit of $ 1000.00 (some places will allow you to get cash back on your purchase - buy for $50.00 and take out an extra $450.00) do it in 2 places and withdraw $ 1000.00 at an atm & voila.

They are responsible for giving you your money back...however don't take your bankers word for it, get it in writing or have your lawyer draw something up demanding your cash right away.

Most importantly, have them write you a letter and have them send a copy to the credit bureau and keep checking up with the credit bureau, cuz I'll tell you that they're slow at updating records. Keep requesting that the credit bureau sends you a copy of all the requests made in your name.

Something else that is very very important (depending on how much information the person has on you and how much the idiot banker gave when giving out a second atm card) MAKE SURE they don't have your Social Insurance Number cuz then you can have more serious trouble - other than having obtained credit in stores, they may just have sold it to someone who's working in Canada illegally and you'll have to pay taxes on whatever they were making. Make sure you advise the RCMP - and call Human Resources Canada to make sure you are covered - Keep all documents for the next 10 years minimum.

Hope that helps. Sorry for the long post.

I know where you can buy tracks and dumps all day long for as low as 35 cents per track.

It is way more common than you might think.

How does the bank know if the claim is legit or not?

Imagine this...You have a friend who lives in another state, and a friend who lives close. You give your ATM card to your buddy and he sends it Fedx to the friend living miles away. This friend clears out the bank account over a few days and sends the card back to your buddy FedX (24 hours). Your buddy living close gives you the card and you go into your bank and try to widthdraw money from the ATM. No money comes out so you flip out and make a scene.
You have the real ATM card to show them, and you can prove you didn't leave the state. Since your using a buddy close to you, no mail to or from you can be traced to the state your money was taken.

I just posted this for fun - DON'T TRY IT.
But how is a bank to prove a thief has your money or it was a scam?
Oh yeah the buddy taking the cash would need to wear a custom and not drive up to the parking lot. They would check the video at the ATM or place used to withdraw the cash.
I thought of this in 2 minutes, with more time you could improve upon it.
How can a guy walk into a bank and say 20K was withdrawn (but it wasn't me) credit my account with 20K.
I just don't see how the bank can tell a real case from a bullshit one.

                                                            Frog,

It may be harder to prove when it's the same debit card & the same code (considering that there were not code changes).

But I think I read that someone fraudulently had a *New* card issued at another branch of his bank, so they take the documents the fraud artist signed and compare to the 'original opening-of-account forms' and they'll know. The other thing is *I think it was done everyday for 3 days* so your Fedexing the card from city to city wouldn't necessarily work from State to State & then back to Canada.

                                                            Just my 2 cents.
