What does copyright law not protect?
Several categories of material are generally not eligible for federal copyright protection. These include among others:

Ideas, procedures, methods, systems, processes, concepts, principles, discoveries, or devices. For an idea or any of the above to receive protection it must be patented, not copyrighted.
Titles, names, short phrases, and slogans; familiar symbols or designs; mere variations of typographic ornamentation, lettering, or coloring. Many clients will ask us how to copyright a name? Unfortunately, the answer to how to copyright a name is that a name cannot be copyrighted. However, a company or product name can be protected by a trademark registration. Unless you actually have the trademark (which it sound like you don't), this is just a silly thread and a waste of time. You really don't know much about trademarks. That piece of paper is truly everything. Not to mention trademark classes and such. We've actually had real life experience with trademark cases and I don't think you have.Comment

My view is that John has nothing to worry about. Trademark infringement actions are extremely expensive to take all the way to court. I doubt any attorney would undertake a case like this without a sizable chunk of change up front.
I have 3 trademarks relating to online entity's that took more than 6 months to obtain and cost around $600.00 each and that is for just 10 years, after which time you have to pay them more $$$..icq. 176240424 44.years as a pornographer !!!!!!!!!!!Comment

As near as I can tell, minusonebit is correct in everything he has stated as long as he immediately begins filing for the trademark.
1. He's got proof of prior use.
2. He's got TMM on record stating they're not using the domain for a legitimate use.
3. The trademarked term is for a product/service (this one is kind of a stretch).

If somebody here registered Baddog.com or JuicyDLinks.com for no other reason than to fuck with them, I'm sure the responses would be much different.
(not a perfect example, since baddog is a pretty generic term and juicy already owns the domain, but you get the gist)

So let me get this straight....you claim that you have been using the trademark 'minusonebit' to sell goods and services online since February 2006 but made absolutely no attempt to register the domain minusonebit.com in that 20 month period although you obviously registered several other domains (some of which you had legal battles over) during that same time frame. And now 3 whole days after somebody else registers the domain you are filing a lawsuit.
I don't think a person needs to be familiar with trademark law to know that any judge is going to dismiss your claim based on the fact that you made ZERO attempt to obtain the domain yourself over the last two years yourself.
The only way a judge could rule in your favor would be if you could somehow show that you were unaware of the steps that need be taken to register an available domain name. The fact that you have registered several other domains but skipped over this one for the last two years is what is going to do your case in. Save yourself the postage on this one, Keith.

How serious can you be in regards to a trademark claim or a cyber-squatting claim when you do not file for the trademark.

I dont know enough of the facts to say whether he has good shot or not. And I'm not really looking to give him legal advice, but the general advice I can give is that if you want to protect your name, file for a federal trademark. Don't try to stand on common law state trademark rights.
The key to a federal trademark is knowing how to write the description. Your trademark is only as strong as the description.Comment
