Is this gonna get ugly, now? Huh? I hope not. Because I thought what we were here, racial differences notwithstanding, was just a couple of old friends. You know, just both of us Californians. -
My point isnt so much that an individual case or whatever of where did you catch it would hold up, its during the appeal when they say heres the helth dept stats on the industry that they are required by law to send us, heres the general population stats, this is why workplace safety laws need to be in place on this industry, they are a burden to the healthcare system and they have a reckless disregard for the safety of their employees, to the extent that they DONT ALLOW condom use.Dont get me wrong I agree with you about optional condoms, but a judge isnt going to believe either of them. Trying to prove that a performer contracted an STI except for HIV and Hep C and possibly syphilis on set will also be impossible.
It would be akin to proving that you caught a flu from your cubicle mate in an office environment.
The California legislature tried to pass a bill last year (AB 375) in favor of hospital workers placing the burden of proof on the employer to show that because of exposure to a blood borne pathogen an infection DIDNT happen. Burden of proof is usually on the injured worker...
The bill was defeated in the Senate... 20-16
http://www.leginfo.ca.gov/cgi-bin/po...b_375&sess=CUR
I dont think there will be a presumption made in favor of pornstars if hospital workers couldnt get one....
If someone at the FSC knew a little something about research legal or otherwise there could be much better arguments being made against Ballot Measure B as B&B points out...
When it comes time to uphold mandatory condom use that's going to be the hurdle we have to clear and we aren't going to do it with bullshit.
We can do better I know you agree I know Theo agrees I know a lot of people in porn agree, why are we being led around by the dumbest among us?
Is Manwin spending a 250K to lead us all to slaughter so they can further devalue or bankrupt the companies they don't yet own? ( Hey I love a good conspiracy theory even if I dont believe it)Mike South

Everyone within a specific region of California will be affected. And even a worst case situation it spreads to other states, which I personally believe is fear mongering, it will not, can not, pass United States borders. So those who will be affected in the industry will actually be fairly limited.
I actually believe "Manwin" does not control anything related to this. However, whoever it is thought it was important enough to hide their whois info so no one knew who it was. The FSC or APHSS doesn't hide their whois info, so that sort of narrows it down to the next in line. You don't hide your whois unless you have something to hide. Can't think of anyone who hides things other than.... hmmmmmm.... I wonder, who could it be?Do not listen to lies from people like mike south that Manwin runs the campaign, Manwin collects the money or any other crap like this. The bank account the money goes to is owned by the organization that runs the campaign, and other than our 150k donations there is no link to us.
No one can provide a name. Just "the organization who runs the campaign." Every organization has some sort of board or membership. Who are they? What person gave the bank their ID when they opened the bank account? Who's signature is on the office lease agreement? Why is it all top secret?
OK, I'm done for the day. Continue on with the fear mongering.Comment

You can never introduce new evidence on appeal. (exceptions for criminal death penalty cases I think) If the trial court didnt get to see it the appellate court doesnt get to take it into consideration. My point isnt so much that an individual case or whatever of where did you catch it would hold up, its during the appeal when they say heres the helth dept stats on the industry that they are required by law to send us, heres the general population stats, this is why workplace safety laws need to be in place on this industry, they are a burden to the healthcare system and they have a reckless disregard for the safety of their employees, to the extent that they DONT ALLOW condom use.
And those reports will never make into a trial court since the Daubert motion will probably exclude it as not being relevant to the case at hand. ( http://en.wikipedia.org/wiki/Daubert_standard )
Im not arguing with you just pointing out that the studies that show STI rates in the industry dont mean anything to anyone except AHF who are using them for PR. They will probably not even be allowed to be introduced as evidence.Comment

I wont argue with ya there its beyond my paygrade I had no law school but it just seems likely to me, and admittedly appeal may be the wrong word, whatever action that challenges the law on whatever basis...seems like to me thats gonna be the battleground since this is a public health issue. (presumeably)You can never introduce new evidence on appeal. I sent you a message.
I simply want to emphasize again that your support against Measure B is desparately neeeded.
It is wonderful to see so many people supporting the campaign...but I know there are many more that can make a difference.
THIS IS NOT JUST A LOCAL ISSUE. If Measure B is passed, it will impact our industry heavily. Take the time to read the bill, get educated and get involved.
I see so many threads here about politics and would very much like to see the same passion regarding this issue. Voting is November 6th - take a stand.Comment

It ain't over until it's over, and then that is just a new beginning...
Lots of newspaper endorsements, and good publicity, which is encouraging.
Imagine if every adult site posted something on their front page, as some sites are doing now (that is a lot of views)...
Added to ADG Home Page this morning:

Vote NO on Measure B, next Tuesday, Nov 6th!

Really . . . .
Uhm - how does the No on Government Waste Committee and Man-Speech Coalition plan to get anything on-air in less than 10 days before an election?
Even radio Traffic Departments need 5 days lead time to put an ad into rotation. TV takes even longer.Publicity and Public Relations for the Adult Entertainment Industry

Hey guys maybe the set up and timing is not perfect and could have been started before, ok fair enough, but at least, someone is trying to do something and nothing really force them to do this, same as the support, nobody force, but what can you loose if you try to help and spread the word..
will you prefer no action because its too short notice... its never too late and always worth something
Having made a lot of marketing campaigns of many kind in my career, the last 72 hours are the most crucial to make people choose/buy/move.
You can advertise something 6 month in advance and its good to make some long term pre-campaign, but peoples do forget easily and the last hours are the MOST important
People will say ok, this vote is tomorrow, well I might go, it has a lot more direct impact than ads seen 2 months ago...especially for a vote like that
And dont worry about medias, most of them will find a way to sell you a spot if you bring new money in the tank, trust me, I bought many ads last minutes and maybe not always the best deals, but they will figured it out something and IT WILL HAVE AN IMPACT
Lets do it !! `)Last edited by Axel_Crak; 10-31-2012, 04:51 PM.Comment

I presume that the ad spots were already reserved, hence the announcement that they will "start airing".
Thanks Michael, for helping me to understand what Man-Speech meant. I thought it was a gay thing at first, so I didn't get it. Now I get it... MAN(win)-FREE (Speech) Coalition.Quote:

The last minute ads this week will have an enormous impact and the small budget VoteNoOnB does have through generous donations is being utilized to do just that - even competing with a multi-million dollar AHF budget - the television ads this next week CAN make the difference.
Thank you for your support!!!!Comment

Well maybe an overnight spot between 11PM and 4AM can be swung at smaller stations. I guess someone put KLOS's ad price on their credit card or something . . . But, yeah South, you and I do think alike more often than not.
No the last minute is NOT the time to be doing this, since mail-in ballots were due today! There's a reason political campaigns start over a year before the election. Same with major motion pictures, but I digress. . . .
I am a professional publicist and marketer and have been doing this shit longer than half these posters have been alive -- the MONTHS leading up to the election, event, etc are crucial. And truth be told, all that past campaigning by the No on B forces was fuckin' wasted on stupid arguments that just made all of us in this industry look like inbred yokels.
I've been putting out better arguments against Measure B for months now, as has Porn Law and many others. Waiting until the final five days before an election to start seriously raising money, and to launch a media No on B campaign? Seriously? Porn Law and I don't get paid the big bucks Diane Duke and the others are paid by Manwin over at the No on B Org, and we have been working for a hell of a lot longer against the measure than the fat cats. ROFL
PS: Thank you Kylie Ireland for doing the radio spots. I haven't heard them yet, but if anyone can make an argument sound convincing, yet sexy, it's likely you. ;)Publicity and Public Relations for the Adult Entertainment Industry
