    Manwin vs ICM Registry and .XXX

    After all the years I spent fighting .XXX, it's kind of fun to be on the sidelines now watching Manwin at work.

    This is, without a doubt, my favorite paragraph in some time:

    "At the very least, the misrepresentation of support from adult entertainment companies, the generation of fake comments in support of .XXX, the submission of misleadingly edited videos and photos, the non-disclosure that certain celebrity adult entertainment supporters of .XXX were paid by ICM, and the creation of a supposedly independent sponsoring entity [the International Foundation for Online Responsibility ? ed.] that was in fact controlled by ICM, are sufficient allegations to establish improper, anticompetitive conduct? under existing case law, Gutierrez wrote."

    I sooooo hope that Manwin finds a way to pry out of lock up those "letters of support" that we've all heard that ICM sent to ICANN.... I would looovveeeee to see once and for all who sent those.

          Hopefully it ends up with anyone who sold the industry down the river to try and gain favor and power being exposed so they can answer for it.

          Sadly though, if I had to guess, I'd guess it ends in a settlement, since most lawsuits usually do.

              I do not see where it would matter. Nothing would change. They would still get bought BRO drinks at the next conferences. If anything, the adult industry has reinforced this over the past decade. It has to be one of the most forgiving industries on the planet.

              It is nice to see some of the same people getting behind Manwin when they step up and fight for an industry cause, especially when in any other thread they are trolled like a champ and blamed for the demise of the adult online industry.

              You gotta love this industry....

                You know, it may be in fact that nobody would care... but I don't care if nobody cares, I still hope those letters are exposed and outed. There's only one game in town in terms of tackling ICM and ICANN and that's Manwin. Seen anyone else do it in court? If you want to debate about them on other issues, you're welcome to do so... but on the .XXX issue, if anything positive is done it will come from them or nobody.

                      The disheartening part of this is... how many comments did we make last time? It was a LOT... and you could count the pro .XXX comments on one hand, and of those, most had financial incentives.

                      ICANN saw all of our comments, and just DID NOT CARE at the end of the day. There was money to be made and they wanted it.

                      I guess I'm at a point where I feel a lawsuit is the only way we'll get ICANN to behave, and since there's only one company doing that, I'm watching the lawsuit with great interest.

                      I'm not saying don't leave comments, but I am saying what I saw from ICANN personally is they could give a rat's ass what anyone says who isn't bringing them money. They are corrupt to the core, like most institutions these days.

                          GAC was against .XXX, if I recall correctly... and I seem to recall ICANN told them to get bent and allowed .XXX anyway. So I'm not sure what power GAC has at the end of the day. I believe that if ICANN wants the money, they'll take it -- UNLESS there are LEGAL reasons why they have to behave.

                          And notice in that judge's comment, he seems convinced ICANN behaved badly and there's reason to investigate possible anti-trust violations. If I were ICANN and worried about anti-trust allegations, not sure I'd want to give the same company control over all the adult TLDs. That might not look too good. ;)

                                  Well if you just mean ANY case involving adult content, I'm guessing quite a few. We don't hear about all the smaller ones, and most cases aren't consequential for the whole industry -- just for the people involved.

                                  I don't know of any recent ones of significance.

                                  If I were Lawley and ICM on THIS one, I'd be looking for a way to buy myself out of this case. Not sure if he agrees with me, we'll see.

                                      You used to be able to just send an email. Now you have to register at their site first. Result: a more time intensive commenting processes that results in fewer comments.

                                        If I thought that they cared about comments, registering would be fine because it would make it harder some someone to send in 1000 comments appearing to be from different people.

                                        But... I don't think they care either way.

                                            Whether this goes to verdict or not... I think those support letters being released would provide us with a LOT of clarity.

                                                        Commenting is great and all, but IMO the most effective way to forestall ICM's application for .sex, .adult and .porn would be to file an objection under one or more of the four grounds for objection that are delineated in the gTLD Applicant Guidebook. Filing a formal objection effectively forces ICANN to answer to your complaints; in comments, ICANN may or may not address your complaints at all.

                                                        IMO, for most people who object to the ICM's applications, the two strongest candidates among the four possible grounds for objection are the "limited public interest" and "community" objections.

                                                        The bad news, of course, is that filing such an objection costs money, you have to pay separately for each type of objection that you file, and the fees are not insubstantial.

                                                        If anybody is interested, there's a lot more detail about all of this in this post from last summer.
