    Babeu calls Obama's mandate 'roadside amnesty'

    FLORENCE, AZ (CBS5) -

    Pinal County Sheriff Paul Babeu is calling President Barack Obama's new immigration policy "roadside amnesty."

    Babeu said one of his deputies recently pulled over a 17-year-old undocumented immigrant and Immigration and Customs Enforcement let him go.

    On June 27, the 17-year-old was caught speeding 50 miles above the speed limit in Pinal County near Merrill Ranch Parkway and Felix Road. The teenager told the deputy he was speeding because he was late for work.

    "He (the driver) says he doesn't have a driver's license and when asked why, he says, 'I can't get one, I'm illegal and I can't get any of the documents in order to qualify to get an Arizona driver's license,'" Babeu said.

    Babeu blamed Obama's recent mandate for his deputy letting the undocumented immigrant go free. He said the president's mandate, where if the person is under the age of 30 and has been here for more than five years, and has no felonies, ICE will not prioritize their deportation, meaning, they stay in the U.S.

    The Department of Homeland Security on Monday issued this response to Babeu's statement:

    "Department of Homeland Security (DHS) officials in Arizona have been directed not to respond to requests from state and local police officers for assistance in enforcing immigration laws unless the individual or individuals in question meet DHS' enforcement priorities. Those priorities include convicted criminals, individuals who have previously been removed from the United States and recent border crossers."

    "For the president to do this - when he makes the good guys out to be the bad guys in law enforcement - we are the ones who racially profile," Babeu said. "And then, with the wave of the hand he says we are not going to enforce the law on these individuals, that is not OK."

    In the interview with Babeu, he also mentioned 287G, the federal mandate that gave Arizona law enforcement the right to enforce immigration law and that was taken away by the Obama Administration on the day of the SB 1070 Supreme Court decision.

          Driving 50 over the limit is going to get anyone a trip downtown, as driving 25 over in AZ is a criminal offense.

              I don't know about that. I've been pulled over a number of times going 115mph in 65 zones, without getting arrested. That got me tickets written up at 90mph.

                No where does it say you cant ticket or arrest a person for a crime. Just that they wont make it a priority to deport them
                Looks like the sheriff is playing politics and is to lazy to educate himself and his deputies.

                  Generally speaking 20 mph over the posted limit is considered reckless driving. Reckless driving is an arrest able offense in any area I know of.

                    American cops must love to arrest people then. Over here, they won't even pull you over for that, but take a picture and mail you a ticket. Even if you do get pulled over because for example you were doing like 210km/h on a 120km/h highway, you won't get arrested. They'll suspend your license on the spot, but you won't get arrested.

                                Which is what should happen to a minor when they are caught driving without a DL.

                                I'm very much all about everything being black and white, and technically the kid should have been arrested, detained, and send back to his home country - and perhaps his parents should have been investigated and deported as well. But at the same time you have to have a certain amount of compassion here - The kid has most likely been here for most of his life. It's his parents who did wrong, not him.

                                      i don't get it some people can break the rules and some can't. a judge in arizona says it's ok for illegals to work. ok if i did the same thing it's illegal because i have to pay taxes. illegals can work under the table as a judge instructed.
