So if some restaurants will give you free coke with your meal you would call other restaurants charging you for coke scammers?
Some registrars charge for whois, some don't its as simple as that. Also other things should be considered, 10$ domain + 3$ privacy is better than 14$ domain and "free" privacy (just a random example, not based on true facts)
