Agreed, but I can also understand that they try to avoid to touch the CP angle - it's gonna take alot more effort and manpower to make this go viral and to push it into the mainstream news - then it's really showtime and soon thereafter game over.

TorrentFreak intimates that a deal has been struck between the parties to settle the case. If true this is troubling especially in light of what TorrentFreak is reporting, that Oron agreed to Liberty's offer of "some public relations help for Oron in order to minimize the chance of other lawsuits being brought against it?.
If true, all I can say is - WTF!

It means they will work with Liberty Media, who will in turn lie, telling everyone Oron is DMCA compliant and is willing to will work with content owners. However, Oron isn't going to give two squirts of piss about anyone else, and they don't have to. That has always been how they operate. It is clear Fisher is going to blow whatever smoke he has to blow to collect a smaller payday, info on uploaders, and the ability to swap links to seed videos so they can track and sue the downloaders.
However, business is business. I'm just happy to have seen that he is just a whore, as I previously held him in much higher regard.
"Disingenuous as it may be" is all that needs to be said. Pay us and we'll lie for you and try to keep you out of trouble.This shall include, disingenuous as it may be, public statements that we are convinced that Oron does have DMCA protection.
Three million frozen in their Hong Kong account and their counter offer is $50,000.
Even if they sue the uploaders AND downloaders, they probably won't collect on what they could probably get from Oron.

They want the uploaders who loaded their content. But how many of them are going to be in the USA? Probably not many. So then they go after downloaders. But they are suing Oron for a huge amount, going after the downloaders couldn't possibly come close to what they could get out of Oron. There is 3 million alone in one hong kong account. A few hundred grand in paypal. Then you have alert pay and ccbill and lord knows what else. It's not like Oron doesn't have money.Comment

Two thing file lockers need to realize.
1. Clean up your act and I'll work with you. I'm reasonable, the industry is reasonable but you have to take efforts to clean up your business. If you are honest about doing so then you have nothing to fear about us. We will even help you do it!
2. Keep pissing me off and I will find all the real evidence there is and report to authorities, post to public for all to see and ensure you never run a file locker again (I don't care how big your fucking company is). Got that ?

I am guessing that some of you guys have never been in a case where they negotiate back and forth like this. Offer one thing, withdraw it, offer another, and back and forth.
Few main things to keep in mind.
1 is that the offer was withdrawn in 1-2 days, and if you look at the dates you see the Randazza guy was hard as heck on Oron after those offers in court.
2 is that Randazza is paid by Liberty. While he would love to do this for all website owners his first obligation is to Liberty and to maximize the settlement in favor of the client that is paying him (even if not perfect for ALL webmasters).
3 We all could have hired him BEFORE Liberty did and we ALL could have gone after Oron before Liberty did. We didn't - and for those of you that visit the XBiz forum you might remember that back in April there was a topic going about many people putting in money for a suit like this and only ONE person ever sent a dime. Just one person... seems hundreds of webmasters had the chance to get involved and didn't.
4 Strategically, Liberty / Randazza might be pulling the smartest move available. $400,000 settlement is one thing. A $250,000 with Oron that includes all user data might very well be better... because that user data would do two things... bring future settlements with direct uploaders and take those direct uploaders out of actions forever!
He might be the smartest damn lawyer in the business - but he is acting in the best interests of his client as he is obligated to do - and that might not seem great to you and me, but damn he sure is taking care of the guys PAYING HIM.Comment

I don't care what the final agreement is financially, or if Oron burns downloaders or not, but I'm not going to change my mind about it being a scum bag thing to do to even offer to lie for Oron, who is one of the worst pirate lockers and a child porn haven. That is just wrong any way you look at it.
Sue them, get their member info, get money, swap links, sue downloaders, do what you have to do, but don't lie for those bottom feeders.Comment

I get all of that, but you are missing the point. Why on earth would Fisher offer to lie for Oron, who is a huge pirate who often ignores DMCA and hosts child porn?
That is about as low as it gets. None of the other stuff matters. Offering to lie to the entire industry about Oron of all sites, is a straight up douche bag move.
