If a site comes up 10th in results but 50% of surfers click that link over the other
9 then it would make sense to move that link up in the results.

Google's ultimate goal is to direct surfers to the sites they want to surf the most,
not to make rankings fair.
I suspect it's not as much time on site or bounce rate which is effectively making them whitelisted more something to do with backlinks and link profiles. There seems to be a pattern where if you have more backlinks Google eases up on the penalties or in some cases even considers your site to be the original source of the content even when it is not.

Without the hundreds or thousands of paid or manipulated backlinks you fall into the zone where you get the scrutiny but the scraped tubes do not.
