Do you see any threads giving us even close to a suggested opportunity to look into it?

The moment I saw the threads I knew exactly what the result of any explanation would be... just check the first few threads, the assumption is that if we don't admit to actively stealing joins that we are lying... so we're either lying or stealing?

unfortunately, the links from this guys .org & .net sites with unauthorized content is still linking up to the join page....

DCMA is not a waste of time - but you have to aim correctly.

              1) DMCA the domain owner. This may be useless, but you have to do it, otherwise everything else is meaningless. If the mail in undeliverable, all the better.

              2) DMCA the domain host. Again, the mail may or may not be undeliverable, and it may be the same person as step 1. This is an important base to touch none the less.

              3) DMCA the IP block holder. This is often different from the host, and sometimes is slightly more successful.

              4) DMCA Quick Buck. They are the ones currently monetarizing the traffic, and as such, have both contact with the affiliate in question and the control over the income.

              5) DMCA Google and Yahoo. Getting these sites out of the SERPs will greatly reduce the amount of traffic they get. It might not stop the violation entirely, but it will remove the profitability. Make sure that you indicate on your DMCA that you have been told that this owner has many other similar sites of similar design cross linked. Google might squish them all with enough complaints.

              6) DMCA Quick Buck's processing company. Again, they have a hand in turning this theft into money, and they have the ability to either make it stop or at least lower it's value to the point that it stops.

If you are truly bored and want to have some fun, DMCA notify Visa in the zone that is processing for these sites. Remember, the implication of all of these sites is that you will find these stars (and potentially this content) inside xxxpass, so there is potential that there is content used without permission / 2257 non-compliant inside the site. Therefore, when in doubt...

Have fun. Remember to send all the mail registered or by courrier requesting signature. Google has a special fax number to send this stuff to, search around on their site to get it.

Great suggestions, the sad fact is that the content owners are somehow often the last ones finding out about the violations and many are tired to act since the work and money involved to send those DMCAs, the time it takes till something happens, the problems arising with domain anonymity, bogus whois data, etc. often make them ignore those violations as long as they don't see any serious change in their stats....

The real key at this point is getting with google and yahoo. They have enormous power to remove the profitability of these ventures, making the thieving pretty much worthless. These sites exist only to snap up search engine traffic and profit from the stolen content.

I think that the owners of Quick Buck run the risk of being contributory infringers if they don't take action to reign in their "rogue affiliate" or at least stop them from making money with this stolen material.

Alex, Thanks for your time with detailing this process out, I hope to find a few other site owners like myself who is affected by this guy to help out in the process... I would haveto admit this seems like a very timely and perhaps expensive process... however, i am fully aware of the long term rewards in shutting him down... thanks again...

Blazing, actually, once you have the addresses in hand, it is exactly the same letter to each, with one change to say "you are the host" "you are the IP block operator" "you are paying these people" "you are listing these sites". Take them all in a pile, and mail them off in one shot.

The google one you can fax, and they are apparently pretty good with these things.

Again for the peanut gallery.. I have now told you how to contact me about this issue several times and you simply refuse to follow my very clear instructions.

Yeah, well, notification is easy... imagine something like this: "Hey tony, the guys on GFY spotted our zango shit, so I am going to have to turn off that account so it looks good. Contact Zango and get the links pulled so we don't waste any money!"

and the fact that an ad is STILL popping up to this very moment with an "account terminated" page is what gave you that deep insight alex?

seriously, how can you possibly make any money spending THIS much time stalking me? my excuse is that I've got a team of 8 people working while i'm goofing off here bantering with idiots.

It doesn't take any time to "stalk" you... why would anyone bother? I don't have zango installed (why anyone would want to have spyware on their system is beyond me) so I can't check. But it was reported earlier in the thread that the popup was gone, so there you go.

However, one of your "rogue affiliates" is screwing a ton of people over and you don't seem to be in a rush to address the issue. Like this one: http://www.evelynlin.net

Anyway, I am sure you will get around to addressing this problem one of these days. You might want to "talk" to this "rogue" as well.

I have also told you now several times that GFY is not our support board and that no matter how many times you post about something on GFY, it will not receive *support* from us.

Brad, with due respect, you provide support to your customers.

I am not a Quick Buck webmaster or client. I am not asking them for "support", I am asking them to look at an issue that is pretty darn clear and obvious. They read it, they know about it, but then they get all officious about "send an email to our support if you want us to pay attention".

To me, that sounds like a company turning a blind eye to an obvious issue, likely because this guys is providing a large part of their business.

Your situation as a host is nothing like a program.

seriously, how can you possibly make any money spending THIS much time stalking me? my excuse is that I've got a team of 8 people working while i'm goofing off here bantering with idiots.

wait so the zango pop up over ccbill pages is now happening again with an account terminated by quickbuck.

WTF? you said you contacted the "affiliate" and told him you would be banning him. Some one said then ALL zango pop ups over ccbill pages stopped all together. All in the matter of mins from a post here saying that quick buck was poping over ccbill signup pages. Now you are saying that the pop up over ccbill signup pages is still happening, but it is saying account terminated ? Why would the guy you notifed start sending traffic again after you told him you were banning his account.

I don't want to be misunderstood, I dislike Hooper and have made that clear lots of times. I believe that his business ethics leave substantial amounts to be desired based on what I have observed.

I think you can also agree that if you saw a post on here "Oh my god all of Mojohost is down" you won't post back "I can't look into the problem until you email me about it". I know this isn't your support board, but I also know you are smarter than to play dumb on an issue like this.

                                                                            http://www.anjalikara.org/

                                                                            Any ideas?

Since the affiliate in question was going against the T&C's, I had fully assumed that my notification would be taken seriously and acted upon accordingly. I sent proof that we owned all content and that their affiliate was in both Trademark and copyright violation. Needless to say, I was just ignored and never received a response back.

The natural conclusion then is that your company places great emphasis on studying the affiliates and working with them to build your business. This "rogue" affiliate was sending quite a bit of business and yet he/she/<you?> would not have been able to demonstrate any sort of traffic in comparison to the sales. NATs provides a number of ways that you would have seen the sales volume and it would have shown immediately that this person was up to something. 50 joins on zero traffic tends to stand out doesn't it? or was it 500 or 5000 joins on zero traffic?

You guys come on here with huge brassy balls basically telling everyone to fuck off and that this is a rogue webmaster. Any program owner that runs an affiliate program smells bullshit in your explanation. Combine this with the fact that you run $50 free trials, it seems to virtually impossible that you were not scrutinizing those affiliates sending joins that did not have traffic to explain those sales. The exact same stats could also indicate an affiliate carding joins to your program, and I fail to see how you would not have measures in place to protect against that, especially since you are running your own merchant accounts. So on the one hand you can catch fraud like someone running joins from a credit card database and proxies, but you cannot catch the "rogue" affiliate who runs joins via a Zango redirect until the shit hits the fan on the message boards?

We filed a DMCA complaint and a Trademark infringement complaint with the prime hosting company at http://www.theplanet.com. They finally acted on it, and removed the illegal content that was up. I did notify them that all the other pages were also in infringement, but I guess they are waiting on the individual site owners to file a DMCA. So if you have one of the noted websites, I would recommend that you also file a DMCA as ThePlanet.com will act on it.

The interesting thing here is that although the content has been removed, when you go to http://www.carolcox.org a join page for xxxpass.com is still there. I do find in amazing, and quite unsettling, that QuickBucks allows this to continue. They obviously are running all the sites in question as anyone else would quickly act and remove the offending affiliate (if there indeed is one). At this point, they are showing that they either own the sites, or are in full collaboration with it. There really is no other explanation....although I would love to hear one from a QuickBucks representative.

Since the affiliate in question was going against the T&C's, I had fully assumed that my notification would be taken seriously and acted upon accordingly. I sent proof that we owned all content and that their affiliate was in both Trademark and copyright violation. Needless to say, I was just ignored and never received a response back.

I did try to handle this privately, but since Quickbucks deemed to ignore this issue I must now ask publicly, will you take action?

I noticed that today too Danny.

One other thing I noticed is the misappropriation of the names and false advertising. Example, this site:

                                                                                                CourtneyCummz.org

if you click a couple of pictures, you get the xxxpass signup, and the page title is "Courtney Cummz 100% Free".

Now, I have to ask: Does quick buck have any legal Courtney Cummz content? Or for that matter, do they have "Carol Cox Web Site, Pictures, Videos, Downloads, News and Links"?

Quick Buck, you guys need to get away from this stuff fast. From where I sit, much of that stuff looks not only actionable, but potential fodder for FTC.

                                                                                                Comment
