    legal question regarding RSS i need help with

    Hello,

    Quick question. I have discovered a website that uses some sort of wordpress RSS parcer to use all blog posts from one of my blogs as his main blog content. I know this is the risk you run offering RSS feeds, but here is my main concern:

    This guy is removing all my links from the blog entries and replacing my links with links of his own to his affiliate programs, and there is no where on the page where there is any credit or link back to my page whatsoever, and is getting better SERP placement than me for many keywords i try to focus on

    I denied his IP in my httaccess which i think will prevent him getting any more of my content, but when i contacted his host they said they are not sure if what he did was legal or not to replace my links with his affiliate links

    i tried looking online but have not found anything yet i can send his host.

    does anyone know if what he did was wrong? Is there anything i can do about it other than prevent him getting more through my httaccess?

    if anyone has any links that they can send my way that i can use to get his host to force my content be removed i would be grateful

      If your content is original then he's committing plagiarism.

          yes, i write my own content, but his host is saying they dont think its wrong since he got it via RSS which is available to all to use...

          i agree with that point... but replacing my links with his own... that just seems wrong.

              Have you contacted him directly yet ? At this point beyond what you have already accomplished, send him the usual Cease and Desist letter and see how he reacts. If he doesnt change his practice then beyond blocking him it may be difficult.

              Unless your original content is copyrighted, as in registered with the US copyright office, you won't be able to file an infringement suit though.

              If you can insert a name that has been trademarked by you into the content, (ex. the name of your site at the beginning of each post) you will have a better claim to infringement and a much stronger argument to get him to stop using your feeds altogether.

                  i tried, but the email i found for his contact bounced.

                  Oh well... i have blocked him so hopefully at least no more content will be used, and asked his host to get him to remove it since there is no credit being given back my way.

                      You could use java script as to encode each of your entries...
