The billing companies don't have a choice. They are part of parcel of the copyright violation if they don't take action. No sane billing company would purposely ignore DMCA notices and add risk to their business.
Further, you need to remember that all billing companies, especially IPSPs, are very beholden to Visa and Mastercard and their regulations. The mere whiff of something illegal is enough to run them into serious trouble. A billing company that fails to answer a DMCA risks putting their acquiring bank on the hook, and that would certainly bring the wrath of V/MC down on them.
