The Video Sharing site is a different company all together, different biz model, different money making model.
Is it infringement? Thats the question.
And I believe that the issue will not be resolved till it makes a court date.

The torrent sites hide in friendly jurisdictions and often behind multiple off shore blinds to avoid being servable. They work hard to be able to thumb their noses at people (see the legal comments and email answers on piratebay).
However, a company like AFF, knowing that a larger percentage (if not all) of the content listed on a torrent site is either ( a ) copyright violation, ( b ) CP, or ( c ) used without permission should have the brains to stop sending money for advertising on the site, especially when notified by the copyright holders. In my opinion, in a court of law, they would have a very hard time justifying NOT taking action to remove their ads from these sites. Further, if it is shown that company principals specifically pre-paid to be on sites, then they may be in double deep.
Remove the money, and most torrent sites will disappear over night. They aren't a "social statment", just another way for people to make money by stealing from others.Comment

On the offending sites discussed in this thread, AFF is often the primary or main sponsor on the pages. Sometimes they are the sole and unique sponsor on the page. They are also one of the most aggressive non-porn companies attempting to get their stuff on adult websites. Please consider the volume of advertising and promotion that they do n this and other boards, in porn industry magazines, etc.
There is in reality about a half a dozen main companies that appear in varying combinations on the offending sites. AFF, Etology, Auctionads, Adbrite... it is rare to find an adult porn company advertising directly on these sites.
It is important to understand also that pretty much without exception, the companies that are running advertising on these sites are NOT content producers and have nothing to lose by supporting theft. In reality, they profit from the theft, because it generates the traffic they are getting from these sites.
I have had a few people say "all affiliate programs take torrent traffic" but my investigating of these sites shows otherwise. Some sites appear on a fairly random basis via etology and adbrite ads, some sites and companies I am sure are buying these ads directly, but the numbers are fairly small.
Remove those four companies from the mix, and the Torrent sites would be sucking air in a hurry. Look at how many bogus fake nick complainers showed up over the weekend after Fleshlight pulled the plug. That was one smaller sponsor - imagine the effects of losing an AFF or the other ad space programs.

Way to put my toughts in clear sentences.Here is something for the people who won't shut up about web 2.0 in this thread. First of all you have no idea what you are talking about.
A community of thieves is a community of thieves. A crack house full of crack heads is a crack house full of crack heads. As Evan said, call a spade a spade.
Now take the crack house example. I own a house, crackheads come into my house to use their crack. In the US, this is illegal. Equate this to what some of you want to call a 'community'.
Now if I get enough crack heads in my house, maybe I can get some billboards on my front lawn or some guys passing out fliers to these people. Perhaps fliers that tell them where they can go to fuck other crack heads?
Now the cops knock on my door. Who's going to jail? Let's see, me for owning the crack house and allowing and profiting from this enterprise. The advertisers for supporting and conspiring in this illegal enterprise. And the crack heads for the consumption of illegal substances.
When you look at victories of the RIAA against users themselves, these people are nothing more than the crack heads in the example above. The person with the site hiding behind what they want to call web 2.0, owns the crack house -a community of people who are there committing illegal activities. The people on the front lawn passing out fliers are the advertisers who support this and make it profitable for someone to run the crack house. I believe that's a conspiracy.
Web 2.0 is about building platforms for the free exchange of information. I have no problems with use submitted content, this is great.
