I have sent the following letter to AFF tonight for Mr. Bloom. Please keep in mind that this letter bears in mind that Mr. Bloom has received copies of our previous documentations per other AFF employees who let us know they were forwarded on to Mr. Bloom.
Subj: AFF sponsored Copyright Infringement Outbreak
Dear Mr. Bloom,
My name is Evan Horowitz from XPays Inc here in San Francisco. Hopefully you have had a chance to review the many emails containing varied and widespread misuse of The Paris Hilton Sex Video to sell AFF memberships. As you know, XPays has substantial rights to the video and also has been assigned the copyright for enforcement purposes as well - in writing.
Please assist us with making sure that our rights are clearly respected by your affiliates and any in-house traffic generation specialists. There are so many cases of AFF sponsored misuse of the video now that the most logical first step to resolving this problem is to clarify your terms and conditions posted on your site as they pertain to XPays, HotelHeiress and TrustFundGirls. I will add some sample text for a clarification to be sent to all of your affiliates with regards to respecting the rights of XPays, HotelHeiress and Trustfundgirls.com at the end of this email. You can craft the letter, but we would like to approve it prior to its mailing and/or posting.
Next, although on several of the notices we provided AFF on thursday and friday last week, AFF suspended the affiliate links of the content submitters- we provided specific examples of ways that our rights were still being abused in conjunction with the selling of new AFF memberships. We also provided banner codes in javascript for several of the sites, which AFF could easily disable more components of the site to totally eliminate the possibility that copyrighted content would be abused.
Also, we requested responses as to AFF's actions taken for each case, accounting,and other details per my previous emails and faxes and posts. I am not a lawyer and should we need to make this a lawyers only conversation, XPays will have no choice but to change my opinion that AFF is sincerely is against the misuse of copyrighted content.
I look forward to working with you & establishing a protocol for future matters such as the events of recent so that we can maintain swift resolutions and the losses that XPays suffers will be minimized.

So how can these pirate sites operate? They either charge for VIP Memberships, or in many cases, have advertisers that knowingly place advertising on their sites (essentially underwriting such content theft), who really don't care where their traffic/sales come from, as long as they make a profit.

90% of the apparent dating sites you see all go to AFF. They use various drop domanis for a bounce, but the traffic is headed for AFF.
Total companies directly involved in financing torrents appears to be about a dozen or less.Comment

I know someone in the pre-production stage for a product we believe is superior to Fleshlight, he was most pleased to hear that Fleshlight has pulled out of torrent sites & would like to thank you for the advantage you have given him at Fleshlights expense.

Respect has to be earned, as a whole the adult industry has not earnt the right to be respected by the consumer, whilst there are no doubt exceptions, by & large you're a pack of dishonest, overcharging scam merchants that deserve all the undermining you get.
You should be spending this time fixing your own glaring shortcomings & becoming respect-worthy, that's where you need to start if you want to minimise the impact of file sharing on your operations, for you will never stop it, you should also be putting the money into protecting your content better & utilising better delivery methods & providing better service at better value for money.

Lets take an example I clicked through to from here, some dingo shit site, good example, directed through page after page of unrelated crap & popups simply trying to get the site/content being offered, only to eventually get there to find it's the same extremely over-priced streaming crap available all over the place.
There are sites providing good value, good service & good honest previews, in other words, being professional in an industry plagued by un-professionalism, don't tell me it can't be done.
An example of a different type, ADG, one of the most goddamn ugliest layouts I've seen, at least you get to it promptly & it is actually a real site, but they charge twice what their small amount of shit is worth & once again, it is nothing at all special, just more homogeneous exploitation of underprivileged girls.
Your time ADG web dood, instead of whining on some forum, would be better spent lifting the quality of your game, then uploading a couple of good clips to a couple of large torrent sites as teasers, striking an advertising deal with them, then checking regularly to get any other posted clips removed promptly. These sites also do not allow CP & rape & most do not allow beast, your portrayal of them all as AFF sanctioned money making monsters peddling CP, beast & rape purely for personal profit is incredibly dishonest, if you are so damn right why the need to lie & deceive.
Going through this thread one could be easily forgiven for thinking the OP is an irrational lunatic, within 4 hours he starts whining about not receiving a response, within a day & a half, & on the weekend, has spammed AFF with shit loads of emails & 28 faxes, sounds like electronic harassment to me. The prices the overwhelming majority of you charge is daylight robbery, unnecessarily pumped up by your stupid affiliate programs that are doing you more harm than good, all they do is help you compete more evenly with each other, but their overall impact on your industry is a huge negative that has destroyed consumer confidence, trust, & efficiency of usability.
Lets take an example I clicked through to from here, some dingo shit site, good example, directed through page after page of unrelated crap & popups simply trying to get the site/content being offered, only to eventually get there to find it's the same extremely over-priced streaming crap available all over the place.
There are sites providing good value, good service & good honest previews, in other words, being professional in an industry plagued by un-professionalism, don't tell me it can't be done.
An example of a different type, ADG, one of the most goddamn ugliest layouts I've seen, at least you get to it promptly & it is actually a real site, but they charge twice what their small amount of shit is worth & once again, it is nothing at all special, just more homogeneous exploitation of underprivileged girls.
Your time ADG web dood, instead of whining on some forum, would be better spent lifting the quality of your game, then uploading a couple of good clips to a couple of large torrent sites as teasers, striking an advertising deal with them, then checking regularly to get any other posted clips removed promptly. That would actually make you money far more effectively than your time whining in this forum ever will.

Xpays and many of you want to dictate where and how a company can promote itself. In the case of Internet Advertising no one can can determine where all sources of traffic are comming from and forcing service companies to look where traffic is comming from is not all that fair and almost outright impossible.
Every day I lose a little faith in the industry, this whole thread is one of the reasons why. It demonstrates just how stupid, and uneducated most of you are.

On a different note I wonder what will happen if some of the web 2.0 adult community will:
a. Analyze the marketing tactics those companies use - I am sure that BT/Tube sites have like very savvy porn consumers that can pour some light on this subject. Let them start with xpays and ADG and then continue to some others here..
b. Get some Christian organizations start monitoring their activities and products - get some web 2.0 users post some nice email to those guys - thousands of them
c. Get the entire web 2.0 publishers - all of the tube and torrent ones expose this shit going on here - maybe even destroy the reputation in public of those programs, companies and people. Can some web 2.0 publishers attention be pointed to this thread? Its only to get a small message on some alexa 800 to 100 web sites, get some blogers and some press on this thread and boom

All Evan is attempting to do is
A: Drive Publicity.
B: Find out if what AFF is doing is actually Contributory Infringement. At first glance its easy to take a side. Which is why its taken me a few days to think it threw on the sideline.
I do not believe AFF is guily of contributory infringement. Infact the only way to see if AFF is a contributory infringer on this matter is to take them to court. Thus this is why AFF will not change a thing regarding Video share sites.
Its all pretty obvious, if AFF did pull that guy as an affilaite it would be an admission of infringement in an indirect way, not only that, but doing so would force them to police all Video share sites and have strict monitors.
