We are all happy to have you come on the board, even though you are a self-professed hobbyist who doesn't do ANYTHING in this industry for a living. My advice would be to do what I did for the first 10 years that I made a living in this biz. Keep quiet and keep your ears open and learn.
You are like the guy who just got hired yesterday to park cars at Steve Wynn's casino in Vegas. And you are trying to tell Mr. Wynn all the things he is doing "wrong".
Brother, you don't have any idea how this industry works. I would advise opening your eyes and ears and please don't try to enlighten people who have had years and years of experience.
Torrent sites knowingly serve up stolen content. The only reason they have ANY traffic is because they are offering that stolen content for free. Deals are cut in this industry a LOT of different ways. Not just through "normal" ways that most of you see.
You aren't stupid. But you are ignorant. And I'm not attacking you. I'm just reading what you wrote and thinking "This guy is clueless, and shouldn't be in this discussion or even on this forum".
Web 2.0 is not about everyone having a right to upload anyone else's copyrighted material (in some cases whole DVDs/sites), until the copyright holder catches them and orders them to take it down (after which they, or someone else, posts it again a week later).
That is what the objections in this thread are about. Plain and simple theft, and the thieves/enablers of the theft illegally profiting from the copyrighted works of others.
If playingwithmyself823 took time to understand this industry, he would find that we indeed support free speech, as much as any industry. What we are against is the illegal distribution of our copyrighted content (maybe if he was a producer instead of a leach, he could understand this).
If the abusing torrent sites took their own rules seriously, they would be on our side, instead of simply using their Terms of Service as a disclaimer absolving them of responsibility. Of course, many of them would not be in business if they were truly against copyright abuse, since their sites depend on stolen content to make money/survive.
A little history of the crackdown on internet copyright piracy:
ADGBitTorrent trackers have been subjected to raids and shutdowns due to claims of copyright infringement. BitTorrent metafiles do not store copyrighted data, so it is claimed that BitTorrent trackers, which only store and track the metafiles and usually do not share any potentially copyrighted data, must therefore be legal.
Despite this claim, there has been tremendous legal pressure, usually on behalf of the MPAA and RIAA, to shut down numerous BitTorrent trackers.
In December 2004, the Finnish police raided a major BitTorrent site, Finreactor. The case is before the courts, and 32 people, in September 2006, mostly administrators and moderators, are facing charges. Software and media companies are seeking damages worth 3.5 million euros (about 4.6 million USD) in total.
Two defendants were acquitted by reason of being underage at the time, but they are being held liable for legal fees and compensation for illegal distribution ranging up to 60,000 euros. The court set their fine at 10% of the retail price of products distributed.
Suprnova.org, one of the most popular early BitTorrent sites, closed in December 2004, purportedly due to the pressure felt by Sloncek, the founder and administrator of the site. In December 2004, Sloncek revealed that the Suprnova computer servers had in fact been confiscated by Slovenian authorities.
LokiTorrent, arguably the biggest torrent source after the demise of Suprnova, closed down soon after Suprnova. Allegedly, after threats from the MPAA, Edward Webber (known as 'lowkee'), webmaster of the site, was ordered by the court to pay a fine and supply the MPAA with logs (the IP addresses of visitors).
Webber, in the weeks following his receipt of the subpoena, began a fundraising campaign to pay legal fees in a legal battle against the MPAA. Webber raised approximately US$45,000 through a PayPal-based donation system. It is unclear how much of that money went to the MPAA. Following the agreement, the MPAA changed the LokiTorrent website to display a message intended to discourage filesharers from downloading illegal content. Webber did not comment on this change.
On May 25, 2005, the popular BitTorrent website EliteTorrents.org was shut down by the United States Federal Bureau of Investigation and Immigration and Customs Enforcement. At first it was thought that a malicious hacker had gained control of the website, but it was soon discovered that the website had been taken over by the US government. Ten search warrants relating to members of the website were executed.
Up until today six admins of the EliteTorrents.org website pleaded guilty to conspiracy to commit criminal copyright infringement and criminal copyright infringement of a pre-commercial release work.
On October 24, 2005, a 38-year-old Hong Kong BitTorrent user Chan Nai-ming (using the handle The master of Cunning, while the magistrate referred to him as Big Crook) allegedly distributed the three movies Daredevil, Red Planet and Miss Congeniality in violation of copyright, subsequently uploading the torrent file to a newsgroup.
He was convicted of breaching the copyright ordinance, Chapter 528 of Hong Kong law. The magistrate remarked that Chan's act caused significant damage to the interest of copyright holders. He was released on bail for HK$5,000, awaiting a sentencing hearing, though the magistrate himself admitted the difficulty of determining how he should be sentenced due to the lack of precedent for such a case.
On November 7, 2005, he was sentenced to jail for three months but was immediately granted bail pending an appeal to the High Court.The appeal was dismissed by the Court of First Instance on 12 December 2006 and Chan was jailed immediately. On 3 January 2007, he was bailed pending appeal to the Court of Final Appeal on 9 May 2007.
On November 23, 2005, the movie industry and BitTorrent Inc. CEO Bram Cohen, signed a deal they hoped would reduce the number of unlicensed copies available through bittorrent.com's search engine, run by BitTorrent, Inc. It meant BitTorrent.com had to remove any links to unlicensed copies of films made by seven of Hollywood's major movie studios. As it covered only the BitTorrent.com website, it is unclear what overall effect this has had on copyright infringement.
In June 2006, the popular website Newnova.org, an exact replicant of Suprnova, was also subject to closure.
The Pirate Bay torrent website, formed by a Swedish anti-copyright group, is notorious for the "legal" section of its website in which letters and replies on the subject of alleged copyright infringements are publicly displayed.
On May 31, 2006, The Pirate Bay's servers in Sweden were raided by Swedish police on allegations by the MPAA of copyright infringement. The Pirate Bay was back online in less than 72 hours, and returned to Sweden, accompanied by public and media backlash against the Swedish Government's actions.
A film, Steal This Film (Stockholm, Summer 2006), relating to these incidents has been produced. The Pirate Bay is now, supposedly, going to counter-sue the Swedish government for millions of Swedish kronor (SEK) lost from having their website shut down. [citation needed]
On May 29, 2007, A federal judge ordered TorrentSpy, a torrent website, to begin monitoring its users' activities and to submit these logs to the Motion Picture Association of America. TorrentSpy's attorney, Ira Rothken, has stated that TorrentSpy would likely turn off access to U.S. users before it started monitoring anyone, since such monitoring is in violation of TorrentSpy's own privacy policy.
HBO, in an effort to combat the distribution of its programming on BitTorrent networks, has sent cease and desist letters to the Internet Service Providers of BitTorrent users. Many users have reported receiving letters from their ISP's that threatened to cut off their internet service if the alleged infringement continues.
HBO, unlike the RIAA, has not been reported to have filed suit against anyone for sharing files as of April 2007. On the other hand, in 2005 HBO began "poisoning" torrents of its show Rome, by providing bad chunks of data to clients.Comment

Writing english as a second language is very tough to fake, but I swear playingwithmyself writes with a European accent. Also, he's not defending AFF in particular. He's stating the fact that a vacant ad spot will be filled before you can blink. (He's also defending bittorrent sites and the "public domain sharing" type theory.)
ignorance is not a defense that plays out well in the legal system- true 'dat.AFF is not a content company and produces no real content. Any rights they would have to any images or videos are those granted by the current rights holders. Xpays is the online rights holder, and they haven't granted AFF a license to use the video or extracts of the video to market themselves, so it is pretty easy to figure out that AFF shouldn't marketed on pages with the video on it.
By your logic, AFF should also run a list of all hollywood movies made and state that they also have no rights to those.
The real logic is: Put your ads on pages where content is used with permission and used within it's license. If you have doubts, pull your ads until the site in question can prove their legitimate use or legitimate distribution rights for the content in question.

although i am completely against lawsuits... these types of online issues are ones where the only remedy seems to be a massive flood of lawsuits holding infringers/contributory infringers liable. what happens online is basically like people driving up to Wallmart, loading up semi-trucks full of goods and driving them across the street to sell at their own store...

Lawsuits are "last resort" tactics, but it is clear that a few companies are just not getting it. The good news is outside of a few sycophants and closet fileshare site owners, generally the opinion around there parts is very negative towards the companies that support torrent and file share sites.
At each step along the way, every time there is a pile of shit on the road of adult, you find the same few companies have stepped in it. It tells everyone so much about these companies morals. If they are willing to profit from everyone else getting ripped off, what do you think the chances are that they shave and cheat on the stats too? we will not hide any repeat offenders who thumb their noses at us. a lot of the raw file of 100's or 1000's of dmca's contains valid active XPays host partners. we handle all issues case-by-case and many companies we met from a dmca or c&d are now great host partners. it would burdonsome to filter the data but we will not hide scammers.hey Evan...

I am going to be hopefully a big advertiser in those adult category sites and I really hope that you will be successful blocking from advertisers as many tube sites as possible - since it will make the job easier for me to acquire new publishers
(at least I am honest with my myself) I can tell you one thing - as an advertiser I am not going to listen to your crap! Tube sites have a right to make money, I as an advertisers have a right to make money as well and there is no reason for me not to advertise on those kinda sites!.
You claim the tube like sites/BT sites are not legal...I am sure that many tube/torrent sites will comply with any abuse email they get - but obviously this is not the situation you whish for... You just want to see them closed - because you are to jealous of their "easy" success.

I'd say they will need rehinting now they have enforced their policy in order to get on specific site's cases. Even then the owners of the torrent site could just say they didn't get the mail etci keep hearing that fleshlight has dropped out of the torrent biz, but just visited adultsins. net a moment ago and the fleshlight banners there on every page are still flying and clicking through... please keep in mind this was brought to fleshlights attention a month ago, not yesterday.
the AFF banners are of course still present, but i doubt anyone needed that to be pointed out..
