wanted to ask you a question... did you ever send an abuse email to tnaflix and actions has not been taken? My point is why do you want AFF to police your content that you yourself do not want to police?
...I have talked today with one of the tnaflix active moderator in the forum. He sounded to me like a nice guy. He is not a criminal and definitely he does not deserve to do jail time anyways, I asked him what does he think on intellectual property and he tolled me that his personal opinion in not relevant and he pointed out the following fact: Tnaflix has to respect all abuse notices by publishers and right owners. Any publisher that wants to get content down can just send an email and one of the volunteered moderators of the site will get it down ASAP. Its very explicit in the contact page. but the simple fact is that he is not getting that much of abuse notices! meaning that you guys have not legal basis accusing tnaflix of any violation! you can say you do, you can scream here in the forums but Tnaflix is simply not to be blamed.

Hey pal,Well, that's some pretty idiotic drivel you concocted...
Nonetheless, I understand that many who seek free content at the expense of the producers of said content, are equally naive about why there is such a thing as copyright laws in the first place, and so I shall try to briefly respond.
It costs me $12,000 to $15,000 to shoot a DVD worth of material. How do I recoup my expense? I legally sell my product, on the internet or through other distribution methods. No one else has the right to sell or distribute that product unless I specifically grant such rights to them.
If someone joins my site, violates the terms of agreement for use of my content, and then proceeds to seed my content to a multitude of torrents sites, where people may view it for free, I may not recoup my costs, I definitely will not make the full amount of money I am entitled to as a result of my creation, and I may not even make a profit, potentially forcing me out of business. What is fair/right about that?
Stealing a product that one person produces, and then selling or even giving it away, to a site that makes a profit from the stolen content by selling advertising, or sending their traffic to Sponsors, is inherently wrong. I assume your parents taught you the difference between right and wrong.
The torrents sites themselves forbid posting content which the uploaders do not hold the copyrights to - but many if not most of them are basically part of a nod and a wink, nobody is responsible system, that in fact often does not respond to complaints, and even flaunts the theft of product that even a simpleton would know should not be there, as it systematically violates copyright holders rights.
The people who advertise or provide affiliate money for traffic/sales, are contributing to copyright infringement by enabling the racket to operate by underwriting their operating expenses and/or helping the pirate sites profit as a result of their criminal enterprise built upon stolen/illegally obtained content.
How hard is all that to understand?
Let's turn it around. Have you ever created anything? By your logic, I should be entitled to duplicate it and resale it or give it away for free, thereby rendering it of lesser or no value to you. Do you honestly believe that would be fair/right for me to do?

AFF has been taken to task for having shady business practices thousands of times here on gfy. It's safe to say they have a history of fucking people over to make a buck. Personally, I hope that laws will be enacted sometime soon that put a stop (or at least a very serious dent) in the rampant unauthorized useage/distribution of copyrighted content.
The DMCA is a failure and has provided a convenient smokescreen for content thieves. It puts all of the burden of proof on the victims of copyright abuse, and has certainly emboldened thieves and scammers.
I personally have DMCA'd people before with mixed results. Many sites hide behind layer after layer of veils - then when you finally catch up with them, they want you to identify by URL every single photo/video that they are hosting/providing links to, taking hours and hours to compile (even though they can easily find and delete all of your content in a matter of minutes since they know who posted it).
Often, if they discover who you are, since you have to register with them to locate your content, they then ban you from their site making it difficult if not impossible to keep tracking your content on their site.
Also, why should I have to provide my private personal info (name, address, etc) to a person that I know already is a thief/scammer (or enabler of such people)?
The only recourse in many instances is to sue them, but most of these people know they are engaging in criminal activity, so they hide behind a myriad of aliases and may not even reside in the country (often foreign) which they claim to be communicating with you from.
It is unrealistic to expect small companies like mine, to have to spend all of their waking hours chasing down infringers, when their time would be better spent creating and marketing their content.
In the case of brick and mortar stores, it is the responsibility of the police to investigate and apprehend vandals, not the individual store owners. Should everyone vandalized close their store and spend all of their time searching down thieves? They wouldn't be in business very long if they did, would they?
Another analogy would be if a store purchases and profits from goods that are stolen, they are liable for that. It's all pretty plain and simple if you are capable of rational thought.
Thieves should not get off free simply by removing the stolen goods after much expense and activity by the person whose goods were illegally stolen, especially when common sense would dictate that the store reselling stolen property had to at least have some suspicion the goods were stolen.
While companies may distribute samples to advertise and generate interest in their product, it stands to reason that nothing would be gained by giving everything away, with no expectation of making any profit whatsoever - and yet whole DVDs/sites are ripped amd posted without as much as a shrug by site admins of torrent sites.
One solution would be a clearinghouse for all DMCA claims. If the same site has repeated infringement cases, they should be shut down. Then the site owners would have a reason to actively monitor and approve what appears on their site. If they can't do that (take responsibility for the content they are offering/profiting from), then THEY should get out of the business, not the people whose stolen products they are profiting from.
As has been shown repeatedly, many of the largest torrents sites have CP and other illegal content in plain view for all to see. Why should their sites not be shut down immediately? Mine would be if I posted such content, yet the people that operate such sites get a free pass simply because they themselves didn't post it (and often do nothing to remove it until notified by someone else).
The government puts the burden of proof on the creators of adult content to prove the age of the models/performers (2257) - why shouldn't torrent site operators be obliged to know that all of the content posted was posted only by the legal copyright holder?
You and supporters of content theft attempt to obfuscate the facts, by blaming the victims. Twist things all you want, but the fact remains, that many if not most of the large torrent sites are nothing but fence operations for thieves, and make most of their profits from stolen goods.
Your solution appears to be, the victims of content theft should quit creating content, since people are going to steal it anyway, and instead create a site that is built upon stolen content and prosper.

This is discussion in not anymore about AFF - this discussion is about some small guys in this forum trying to convince the world how "pirated" sites are stealing your business. You are accusing the wrong people - simply because you don't understand nothing about modern internet and are to mentally blocked from seeing the big picture. Web 2.0 is here to stay - what you see today happening is only the start. Video streaming sites like youtube and even bittorrent sites are all Web 2.0.
You are trying to make the web masters of such systems thief's - well that's don't going to work for you guys and it will never will! You will never have legal basis for that!

If you go after the hosting, those type of sites will often move to a new host rather than face the issues. The registrar is a long shot, best to go there with invalid information on the whois records or a "hidden" whois, that gives you tons of weight in the game.Just wondering... Removing the money, the financial motive for these sites will stop them cold. Without a way to make money, 99% of the "file sharing" sites would disappear within hours. If they have no way to turn traffic into anything but bandwidth bills, they will be gone.
Tempest, while Evan many not go after these those companies, discussions are underway. Contact has already been made with AVN regarding their "service provider" Adbrite, As for the other links you provide, you have to dig deeper because often what you are going to is nothing but a white label of someone else's product, or a redirection page to someone else's product. The reality is that there are very, very few companies willing to be part of torrent and file sharing sites, and with continued pressure and various steps being taken, they should find it more and more uncomfortable to be there.
You forgot to mention Etology, another company that is often found on torrent sites... remarkably, run by two ex-AFF employees. Makes you think maybe that they learned their business ethics from Lars and Andrew.

If you go after the hosting, those type of sites will often move to a new host rather than face the issues. The registrar is a long shot, best to go there with invalid information on the whois records or a "hidden" whois, that gives you tons of weight in the game.
Removing the money, the financial motive for these sites will stop them cold. Without a way to make money, 99% of the "file sharing" sites would disappear within hours. If they have no way to turn traffic into anything but bandwidth bills, they will be gone.
Tempest, while Evan many not go after these those companies, discussions are underway. Contact has already been made with AVN regarding their "service provider" Adbrite, As for the other links you provide, you have to dig deeper because often what you are going to is nothing but a white label of someone else's product, or a redirection page to someone else's product. The reality is that there are very, very few companies willing to be part of torrent and file sharing sites, and with continued pressure and various steps being taken, they should find it more and more uncomfortable to be there.
You forgot to mention Etology, another company that is often found on torrent sites... remarkably, run by two ex-AFF employees. Makes you think maybe that they learned their business ethics from Lars and Andrew.

Torrent sites knowingly serve up stolen content. The only reason they have ANY traffic is because they are offering that stolen content for free. Deals are cut in this industry a LOT of different ways. Not just through "normal" ways that most of you see.

AFF is not a content company and produces no real content. Any rights they would have to any images or videos are those granted by the current rights holders. Xpays is the online rights holder, and they haven't granted AFF a license to use the video or extracts of the video to market themselves, so it is pretty easy to figure out that AFF shouldn't marketed on pages with the video on it.Evan,

By your logic, AFF should also run a list of all hollywood movies made and state that they also have no rights to those.
The real logic is: Put your ads on pages where content is used with permission and used within it's license. If you have doubts, pull your ads until the site in question can prove their legitimate use or legitimate distribution rights for the content in question.
AFF chooses instead to use the "until you tell use we don't know" sort of logic that is arrogance at it's highest level.Comment
