on monday when aff gets in the office it will probably have been 4+ days that their banner codes have functioned right next to links promising our content. sure, the affiliate is suspended when you try to download the torrent but the aff banner still functions everywhere else.

I have been following this thread recently and this is my opinion - The fact it that some of copyrighted content is being uploaded to the web and it seems to me that you are too fucking pissed from this. As for the evolvement of new sites like tnaflix, megaupload etc.. you are feeling that they threaten your existing business practices. Megaupload as for many other sites in this category is user generated content.(Web 2.0 so to say...) meaning that the admins of the sites are passive in regards to what content is uploaded. They supply the platform. Those sites also never express specifically what type of content the users should upload. So the real guy to be blamed is the community not the sites admins.

You call them thief's? can you tell me who exactly are you calling a thief? Is it the site admin? Do you think that he uploads the content? Do you think that he has like a secrete Armey to upload pirated content for him? The answer is NO! The entity you are referring to its the free voice of people and this is what you don't understand! you just don't get it! Its people.... millions of people that vote with their free voice and web actions. The simple fact it that the majority of people do not threat adult intellectual property as they will threat physical property, although some of you would like to convince the world that this should not be the case. The majority of people do not think that uploading or viewing a movie on the web is like stealing a car! I don't think so either. Stealing is an abnormality Phenomena. Most of the people don't steal - not because they are too afraid of going to jail. Many robberies can be done on a daily basis with zero risk and still people do not generally steal. But with Intellectual property its a different thing - the abnormality here is actually not to download movies from the net. You see - you can not call the majority - thief's and if you will continue to do that then one day no one will protect your business any more and your principls will be irrelevant!

You need to understand that those type of sites will never ever close. It does not matter if you get flesglight out of them or any other advertiser. They are just not going to disappear and there will be always somebody - some where that will be whiling to do business with them. Actually, by banning some of the advertisers from them will lead for those sites to accelerate with some more aggressive business models by selling some added value services directly to the users that will even greater threaten your business model. Look at TNA flix - they are going to sell premium membership - which means they will provide high quality streams to users that will pay some extra $$$ for bandwidth. This is just one small glimpse of those practices I am talking about. its unstoppable! you will soon discover that you are fighting an undefeatable war!

Any publisher that wants to get content down can just send an email and one of the volunteered moderators of the site will get it down ASAP. Its very explicit in the contact page. but the simple fact is that he is not getting that much of abuse notices! meaning that you guys have not legal basis accusing tnaflix of any violation! you can say you do, you can scream here in the forums but Tnaflix is simply not to be blamed.

So the truth is that you don't want any sites to take down your content and comply, since you have send so many emails to aff and fleshligh and having this massive posts in the forum but you did not send one single notice to tnaflix for abusing a movie You just want to convince all he people of the world that they are thief's.

This is not a shocking development. AFF was part of zango, file sharing sites, so this is no big shock. I wouldn't ever want to make xpays mad. Even a big company like AFF should be worried at this point.

So when a user views a clip on megaupload he can send it for a sms fee to his mobile phone.... Nonetheless, I understand that many who seek free content at the expense of the producers of said content, are equally naive about why there is such a thing as copyright laws in the first place, and so I shall try to briefly respond.

It costs me $12,000 to $15,000 to shoot a DVD worth of material. How do I recoup my expense? I legally sell my product, on the internet or through other distribution methods. No one else has the right to sell or distribute that product unless I specifically grant such rights to them.

If someone joins my site, violates the terms of agreement for use of my content, and then proceeds to seed my content to a multitude of torrents sites, where people may view it for free, I may not recoup my costs, I definitely will not make the full amount of money I am entitled to as a result of my creation, and I may not even make a profit, potentially forcing me out of business. What is fair/right about that?

Stealing a product that one person produces, and then selling or even giving it away, to a site that makes a profit from the stolen content by selling advertising, or sending their traffic to Sponsors, is inherently wrong. I assume your parents taught you the difference between right and wrong.

The torrents sites themselves forbid posting content which the uploaders do not hold the copyrights to - but many if not most of them are basically part of a nod and a wink, nobody is responsible system, that in fact often does not respond to complaints, and even flaunts the theft of product that even a simpleton would know should not be there, as it systematically violates copyright holders rights.

The people who advertise or provide affiliate money for traffic/sales, are contributing to copyright infringement by enabling the racket to operate by underwriting their operating expenses and/or helping the pirate sites profit as a result of their criminal enterprise built upon stolen/illegally obtained content.

How hard is all that to understand?

Let's turn it around. Have you ever created anything? By your logic, I should be entitled to duplicate it and resale it or give it away for free, thereby rendering it of lesser or no value to you. Do you honestly believe that would be fair/right for me to do?
