    I've been dealing with a host who has illegal content hosted within the USA, CP, Scat etc. But, the company that owns the site is outside of the USA.

    I spoke with the CEO and head of abuse VIA a conference call and was told that the host is for one not liable for any content on their servers if the company that is hosted the content is not within the USA. That they need to comply with the local laws of the area the INC is in.

    Basically saying if Scat is Legal in Tonga I can inc there and host at Nat Net or Phatservers or Webair or ISPrime and it be fully legal..

    I would like to discuss this more, as I am trying to take action.

                  Who are the GFY resident hosting owners? This topic was only created about 12 hours ago. Maybe contact them directly instead since there are only a few this topic is really targeted at.

                              Legally hosting companies can not do anything until there has been a complaint filed and has been notified by the authorities.

                              Sure people may contact you.. tell you about the illegal content that is being hosted on the servers.. but as far as our lawyers tell us NOT to remove anything or DO ANYTHING until we have been served with a DMCA or other legal notifications of the material.

                              This protects the company in case there is any legal problems.. They can not be held liable for "monitoring the content of the network", once a company starts monitoring legal/illegal content they are now liable for everything. So even if the provider knows the material in question is illegal we can not take action and remove it until a former complaint/legal notification has been issued.

                              Solution? get the FBI/police involved and they will have to listen.

                              This is a very common problem for people who host warez/copyrighted material etc... its all fine as far as "hosting" goes until the host takes their own action and terminates accounts. once they do this they are liable for everything.
