More over we do have a safeguard. Once an affiliate has been BANNED all of his contact is put on a blacklist - if that affiliate signs up for any of our sites with the same contact information then the account will automatically be BANNED.
In essence they can not promote with us again ever.

Correct me if I'm wrong but there was no affiliate code in the promo, so it must have been pre-paid ads spots. How do you know who the affiliate was with no ad ID ?
Secondly : Time to hire someone to look over affiliates accounts and how they are getting promoted. You guys gross in 200 millions a year in revenue, paying 5 staff $15 per hour shouldn't be too hard.Originally posted by rayadp05Comment

The problem is that they aren't doing anything to prevent it.
Even if they have 10 000 active affiliates, it would be quite easy too build a tool where 2-3 employe could review 100-200 a day each to make sure there isn't any illegal content on the website and investigate if there is. Ad-Sence are doing a great job at doing that, I don't see why affiliate program owners shouldn't be responsible.
When they tell everyone publicly they can an account, and you look at the website in question and the ads are back up with another aff ID a week later, there is a problem.Originally posted by rayadp05Comment

So what's to stop them from changing their "info" (fake name, fake info, new epass acct or rented mailbox)? The fact is that AFF could EASILY integrate some form of affiliate site monitoring. For instance (just as an example), it would be simple to have a quick script written that monitors where the affiliate traffic is coming from and if the traffic is coming from a known torrent site, BAM the acct is red flagged. This obviously wouldn't take care of the problem entirely, but I guarantee you it would catch a significant portion of it, and that would be a start. It doesn't take a rocket scientist to come up with ideas that would require very little manpower to institute.

oh fuck them. they have made it quite clear that they could give a flying fuck about their services enriching those who steal all of our content. i've been pretty critical in the past of Xpays in terms of their trademark lawsuits at certain times, but this would forgive all.
i hope AFF and anyone who banks off their shady fucking company are all sweating now that something is finally going to be pursued.

So you can honestly say that a random search of Torrent sites would not turn up any AFF ads?
I found a half dozen since my last post a short while ago, with a simple keyword search of torrents +porn +AFF.
You have the luxury of knowing the site URLs that the torrents clients you pay are sending traffic from, and yet they are still out there in droves ripping off people in the adult biz.

You act as if you think they are stupid...they are not stupid, just greedy. If people in the adult biz (or mainstream for that matter) get ripped off, AFF seems to not care until they get called out publicly on it.

One thing I learned in dealing with AFF is that they have no corporate common sense. Their line is "when someone gets charged, we will consider it potentially illegal and stop". until that point is crosses, they don't give the proverbial rat's ass.
If it hasn't been judged illegal, it is by default for them legal.Comment

If your copyrighted picture is on someone's AFF profile, then yeah, send them a DMCA notice.
However, in terms of advertising on sites with illegal content, the DMCA does not offer AFF any safe harbor protection and therefore a DMCA notice is not only a waste of time, it is irrelevant.
In fact, let me further hypothesize....
Willful infringement is not only a civil matter, it is a criminal one as well. The argument could easily be made that torrent sites willfully infringe, thus committing a federal felony.
As an advertiser, and one who is well aware that torrent sites are willfully infringing, AFF could in fact be considered an accomplice in a criminal enterprise. Part of a conspiracy.
This is just my hypothesis and opinion, thinking out loud as it where. I am not a lawyer or a law enforcement official so this argument would be better left to them. In other words..I am not accusing AFF of a criminal act, just voicing an opinion that may or may not be relevant to the discussion.Comment

There are ways to block specific URLs from pulling your images. In fact, AFF should invest in a system for blocking URLs instead of just contact information. It is easy to create a new account in someone else's name and simply start running the ads again. A URL block would ban them from ever advertising AFF again.Comment

That might be a too technologically advanced solution for AFF.
You guys keep making it sound as if AFF (and the other advertisers) could actually do something about the problem, except react piecemeal when they are publicly called out about it...
I applaud the lawyers who finally decide to take on the scammers and thieves, and those who support/enable pirate sites through ad sales and affiliate dollars, and I hope they all get what they deserve (or at least get put out of business).
