There is a lot of testimony recanted... who knows. I guess a systematic way to erratic killers is to kill them. Does 2 wrongs make a right?

          Not my opinion, but fact:

          http://www.cbsnews.com/8301-504083_1...32-504083.html

FORT COLLINS, Colo. (CBS/AP) After wrongly locking up Timothy Masters for nearly 10 years, Larimer County has agreed to pay him $4.1 million to settle a federal lawsuit.

Masters was convicted in 1999 for the murder and sexual mutilation of Peggy Hettrick in Fort Collins, Colo. In 2008, a judge overturned the conviction after DNA evidence pointed towards another suspect. Masters, a former aircraft mechanic, was the first person freed from prison in Colorado because of DNA evidence.

In 1987, at age 15, Masters came under suspicion after he saw a body in a field but didn't report it to police. He was arrested 10 years later due to a psychological analysis of his drawings that investigators said pointed to Masters as the killer.

Prosecutors Blair and Gilmore were rebuked in 2008 by state attorney regulators. Both acknowledged they failed to ensure defense attorneys received several key pieces of information obtained by police that called the prosecution's case into question.

Masters' lawsuit claims detectives and prosecutors maliciously targeted him and destroyed or withheld evidence that could have cleared him. Claims against police and Fort Collins are pending.

"Tim has been basically destitute since they released him from prison without an apology," said his attorney David Lane. "This gives him a good chance to start putting this behind him."

No decent 2nd or 3rd world country has it either. In fact I'm pretty sure less than 10 countries in the entire planet have an active death penalty, including the likes of, I think, China, Iran and Saudi Arabia. That's nice company to keep.

Something tells me when there is any uncertainty about anything in cases such as this, we should err on the side of not convicting and sentencing to death. If 100 people had seen the guy shoot someone, that's one thing -- but this sounds sketchy.

BTW, the death penalty is giant waste and an antiquated concept. It doesn't deter anyone from committing murder, and it costs so much money keeping a death row inmate for years, and all of the court appeals, etc. We should try to get to the source of our problems, instead of putting band-aids on them. Invest in the education system, not prisons.

It was 9 people, not 35. 7 of those 9 have recanted their statement claiming they were coerced by police. 3 of the jurors also say they now believe he was not guilty. Another inmate confessed to the killing to another inmate but that was not admitted.

                                Bullshit

After a trial before a jury of seven blacks and five whites, in which 34 witnesses were called for the prosecution and six for the defense (including Davis),

Following the original trial, seven witnesses changed or recanted all or part of their testimony; others, including a man who identified Davis as the killer, did not . Davis and his lawyers argued that the racial composition of the jury and poor advocacy from his lawyers had affected his right to a fair trial
Racial composition of jury. LOL. 7 blackas and 5 whites. I guess they wanted to have all 12 black jurors.

Knowing that killer paid the price would make things just a bit better. Its called serving justice.

just so you know.. he pistol whipped a guy at burger king (maybe it was the manger) in front of his gf around the same time of the shooting of the cop...

they never changed their story that it was davis, but they were white and somehow became not credible to the defense and davi's supporters..

even the supreme court reviewed this case and decided that the decision was correct..

i dont know what else can be done..

i do believe that if he didnt kill a cop then they would have commuted the sentence to life, but rules are rules and when you kill a cop, you get the death penalty...

whether you like it or not, it makes people think twice before they kill a cop..

if it didnt work as a deterrent, there would be a lot more cop killings then there are...

How very humanitarian of you. Doesn't the death penalty deter drugged up thugs murdering wives and children then?

Life imprisonment is what I think..

unfortunately in some countries, the killers that get sentenced to Life imprisonment, stay free after 10 or 15 years. Probably because you have many social organizations fighting for the "HUMAN RIGHTS of the KILLERS"... Of course I hate that.. and i think that they must stay in Life imprisonment..

but DEATH PENALTY is quite retarded and NAZI, seriously...

Let's just say for the sake of argument he wasn't the shooter, why the hell didn't his brother testify in his defense? What motive would the police have to frame this guy?
