I just found this on his site. But he says people are emailing in pictures. So Mike what is correct? You have all the documents or the people posting them have them or not. How do you know who is posting these pictures.

all pictures on this site are believed to be within compliance of the title 18 section 2256 of the u.s. code, as well as compliant with coppa. please report all offenses immediately to webmaster at mikeproject.com.

Mike, definitely get more strict on every submission. I'm assuming you review all pictures prior to listing. But for a Rate My Thong site, you're better off requiring a 18+ limit. There's no use risking it, especially since you're not making any green.
Exactly, Sites like these have been in every major magazine and radio show, Hotornot, ratemyface etc...... half of the submitters are under the age of 18, i am sure if this was illegal, it would of been brought up far before this thread

so all the pictures of britney spears in skimpy outfits, showing some thong and such from before she was 18, that were published everywhere, in magazines, television, as well as i *know* some of you very people condemning me as a "pedo" have seen or collected - those would be illegal?

i made the mistake of asking a porn industry board about a non-porn industry site. i do not need anymore half-baked opinions or anything. simply put, if you're not a lawyer, your advice and opinions adds nothing to this, if you are a lawyer, contact me because i would like your services.

i am already working at ensuring my sites are cleaned/well within the bounds of usc 2256, and yes, that does mean i still can have pictures of people under 18, because that is hardly illegal. i just had some borderline things and i wanted to get that cleared up, and i figured this board had some people who would know who to contact in regards to asking for advice/guidance on CP. instead, i get a lot of personal opinions and baseless name calling. let's just drop this topic, mmkay? i've gone down another path to ask people who know what they're talking about

Someone who has sex with a 17 year old girl (knowingly) is breaking the law (age of consent varying from country to country and place to place). Now, legislators can pass a law saying white is black, but that doesn't make white black.

I'm just a defender of the language here. I don't think people should boff children, but I do think words should not be polluted by stretching their definitions to the breaking point. A person is not a "child" the day before their birthday and then an "adult" on their birthday except in the eyes of the law. That would be absurd except as a legal construction. But we do need laws, and if the legislators feel that 18 is some kind of turning point, generally speaking, then that must be respected.

If you're in the porn industry, then you did ask your question in the right place. If not, why are you posting on this board?

If you even get into trouble, your entire business will be looked at, not one site. They will confiscate your computer, and some cool picture you downloaded from a website (or worse, newsgroup) will come at issue, and if you're asked "How old is this person?" how will you answer? They will call in a pediatrician who may say, "She might be as young as 16 or as old as 18." If a judge or jury decides she looks more like she's at the younger end of that scale, and you can provide no proof otherwise, that will be weighed along with everything else against you.

You have a point, but, in california, if you have sex with a minor, and are caught you are a sex offender and MUST be registered with the state as such.

Having sex with a minor does make you a pedophile, even if she is one day short of 18!

              The law is there.

i don't believe that this guy is a pedophile.

but it's always better to stay off those grey areas. or, at least, to consult a very good lawyer.

but he does have a point about brittney spears - how much of you wanted to "give it to her" when she was 17? what about the pictures that were especailly created to "conduct a sexual feeling"?

You asked our advice and when we did not give you what you wanted to hear you shoot us down.

I've been in porn from before you were born and my advice is, which you asked for, your site is pornographic. If I was on a jury and asked if titilating pictures of 13-15 year old girls was CP you would go down.

And that is from a guy who shoots "Teeny". What you do not realise is who took the pictures on your site. The girl with a timer on the camera, her boyfriend or an "Uncle Ernie" (from "Tommy").

You do not know what happened to get these girls to pose like that. Before or after the pictures were taken. How do you know that each and every girl was willing to pose semi naked, got an ID shot, Model Release? How do you know that that is as far as the photo session went? You do not know and do not want to know. In your mind "Young girls like doing this, they want to do it" That is the excuse of every peodophile.

If there's no nudity and no sexual conduct, maybe you avoid federal anti-child porn laws [must be actually children engaged in sexual acts --real or simulated-- or shows genitalia in a very sexual way] The real problem for you is STATE law. Under the Supreme Court's Miller case, local standards apply.

Bottom line, consult a lawyer. Further warning: even if a lawyer gives you sound advice, it doesn't take much for a particularly zealous district attorney to persuade the increasingly conservative courts to "interpret" obscenity in such a way that it gets you thrown in the slammer.

Some states are more hardcore, in terms of prosecution, than others.

shit, in russia anything is legal. actual child porn (even girls at 9 years old) is legal.

this wasn't the right board to be asking my question in. everyone here is concerned in regards to the porn industry. as pipecrew said, there are plenty of sites out there just like mine where people post their pictures (and a large portion of them are under 18) - right now i am scrubbing my site to get rid of the under-18 very risque photos, and flagging possible issues for when i talk to ASCAP and a lawyer.

inside of the definition for usc 18 sec 2256 it talks about "sexually explicit conduct" either actual or simulated - i've ensured that none of the under-18 pics on my site are looking that way at all. the rest is up to someone's definition of "simulated acts" - someone could say just by a girl posing showing her stomach, that is porn.

this is the grey area i will visit with people who know what they're talking about.

Sorry G Sharp but your response is not too sharp.

Some of these things you mentioned can get you busted for cp, nudity is not necessarily one of them...look up Jock Sturges.

Also to be cp the minor does not have to be undressed or nude.

One case in point a man videotaped young girls in leotards at a dance/gymnastics recital but maintained focus on the genital area.

The young girls were clothed, but centering on the genital area changed the context of his video from that of just a simple home video tape to cp.

He could have by all rights videotaped the young girls completely nude avoiding the focus being maintained on the genital area and could have escaped prosecution.

Anyway to whoever started this thread...you have to consider the context of the situation. That is established by your business, and the sites you run and the sponsors you promote and of course the pics themselves.

Many posters have given you every reason to not run a site like this the key factor being lack of 2557 info...model release, parental authorization etc.

If you can't decide at this point what is the right thing to do then a lawyer isn't going to be of much use to you either...you've pretty much made up your mind what you want to do.

As a parent of two teenage girls i agree wholeheartedly with UnseenWorld. There is a place in "legitimate art" for the display of nude or semi nude bodies of all ages....but to use suggestive images of underage people ...male or female anywhere in the adult industry is WRONG. You may not see it that way...but unfortunately (for you at least) the the law does.
and your age (or lack of) doesnt hold water in the eyes of the law either

please note you mentioned "adult industry" - this site is not in the adult industry. my original post must have confused people, it's original intent was just to get names of people, groups or resources that i can look up and get information from only.

Mike503 - if you are starting to wonder about what you are doing - then you are already crossing the line - stop right there and re-evaluate what you are trying to acheive.

All the self righteous moralists - shut the fuck up.

Unseen - you are spot on - words are bandied around

sex offender (not =) pedophile A rapist is a sex offender but not a pedophile. I abhor people who sexually abuse prepubescent children (the actual pedophile according to abnormal psychology). That would be absurd except as a legal construction.

which is exactly my point. a couple days ago i got some pics in that weren't nude, but were definately too close to being nude for my tastes. i asked another's opinion and he concurred. so from there, i wanted to get a concrete definition to work off of.

this wasn't the right board to be asking my question in. everyone here is concerned in regards to the porn industry. as pipecrew said, there are plenty of sites out there just like mine where people post their pictures (and a large portion of them are under 18) - right now i am scrubbing my site to get rid of the under-18 very risque photos, and flagging possible issues for when i talk to ASCAP and a lawyer.

inside of the definition for usc 18 sec 2256 it talks about "sexually explicit conduct" either actual or simulated - i've ensured that none of the under-18 pics on my site are looking that way at all. the rest is up to someone's definition of "simulated acts" - someone could say just by a girl posing showing her stomach, that is porn.

this is the grey area i will visit with people who know what they're talking about.
Not true, In russia they still have laws which are pretty similar concidering pedophilia/concent the law enforcement may not have the power to enfore them and may be bribable but the laws are still there

Dude, seriously. TAKE THE SITE DOWN. At least until you make some serious changes to it. Some 40 year old is going to see his daughter on your site and call the cops on you. First change: use a submit page on your website that you have to (under penalty of some sort) affirm that you are over 18 years of age. Just a suggestion. I know, I know, they'll probably lie anyway. But it is at least something to tell the jury before they send you off ANYWAY.

Oh, yeah. One more thing. If I had a kid and I saw you even look at him/her I'd take you out and not even think twice about it. Fuck you. Hell, I'd like to beat your ass just for the fun of it just for the sake of those poor kids out there that apparently think it's the cool thing to show off thier asses to men who should be in mental institutes or medication or some shit. Yeah asshole.

I can't believe how stupid you have to be to even ASK that kind of question in here. How hard is it to understand??? Yeah, I saw your site. If I were a pedophile I would go straight to your website all the time. It LOOKS like you enjoy this shit. Why would you even let 16 year olds post pics in a tight outfit? CAUSE YOU LIKE IT. You make me want to vomit.

Do us all a favor. Grow up yourself because you act younger than some of those girls on your site.

Even this is inadequate if you operate in the United States. You need (or, as is more often the case, the producer at least must have...and this is a good reason for using established responsible producers) documentary evidence of age (18 or older) accepable under Federal Law (Title 18 USC §2257) and a release signed by the model giving permission for the intended use. Without BOTH of those, you're way out on a legal limb.

There is only certain content that is subject to 2257, and even many solo soft nude pictures aren't subject to it, from what I've read.
