i agree they look alot like each other
but unless u can proof they have knicked your exact graphic u cant do shit
nobody has copyright on a layout u have copyright on graphics and text

the very top graphic is stolen, the top 1/2 inch of the page.

It is an exact ripoff of the main page layout(they added to the bottom).

Without question they ripped it off.

if the Hun can copyright a "database of links" a body of work consisting of a webpage can be regarded as "Artistic Property" and have "Artistic Value" which makes it worthy of theft and copyright violation...

Because a webpage begins as "code" writer of that code owns it, and unpublished or published literature can be copyritten.

But who knows.

That's a nice theory, but it's just some person's opinion. Even the guy you linked to just says this:

"I am of the opinion that a webpage layout may be copyrighted if it is actually written and/or designed by the author..."

Imagine if they upheld this theory in court. There would be a total of 100 copyrighted designs on the web. Everyone else would have to pay those 100 people to use a site that looked anything like the other sites.

We're all posting on a forum that looks exactly like every other forum. Who can we sue?

Again, I think it's fucked up when people borrow designs in many cases, but I doubt you're going to win any lawsuits over it unless they are stealing code or images directly.

In this case though, it was more than just a layout that was stolen. The top graphic for example, is exactly the same.

It could be that whoever did the design for them ripped them off aswell and they don't know about it.

Agreed. If someone is actually stealing pics or lots of code, then that's got to be illegal under copyright law.
