Someones lawyer would probably have to get a judge to ask for the security tapes, as I dont think just going there and asking is going to do anything. They will protect themselves before helping others. Thats the way of it these days.

she used her card and a friend's card that shared the room..
Those are the only cards she was aware of on her bill.. and the bill that the Hard Rock faxed to her.. Wasn't til after she was outa there that the other card issue came up...

For what it's worth, last time I paid for a hotel room, I just gave them a room number and did not have to verify the name on the room. I'm not sure if that was a special case and they were supposed to, but I just told them it was room xxxx and I'd like to pay cash, and they said sure, it is $xxx thank you have a nice day.
The only conclusion I've been able to draw from this thread is that Smashbucks and Mike Hawk look really bad.

Just an FYI - several years ago Shok and I checked into separate rooms at the same time in Vegas. They put both our rooms on HIS card. His wife was not amused when she got a call about the high usage on his card (mebbe if he didn't have so many Spectravision porn movies.....). Anyhoo, total mistake by the front desk.
2 weeks ago I upgraded to a suite. I was staying 3 nights and they charged me 9 NIGHTS of upgrades.
I would estimate that at least 50% of the time charges are wrong on my hotel bills. Most of the show attendees aren't paying for their bill so they probably don't even look. When you have a hotel filled with people you know, the chances of a mistake reflecting on someone ELSE you know's room bill is going to be high.Comment

Anyone v. Hard Rock: Not going to happen. They did nothing wrong and rectified the situation immediately.
Caza v. Sparxxx: Won't happen in superior court, doesn't meet the statutory requirements. Could happen in small claims court but proving that there was $1000 in the wallet would be next to impossible. You can't just SAY what you had, you have to prove it.
Sparxxx v. Mike Hawk/Caza: There is a case here, especially if she loses the booble contest. But regardless of whether or not there is a strong case, I would gladly pay for the audio transcript:
Clerk of the Court: Now Hearing Sparxxx vs. Mike Hawk. Is Ms. Sparxxx present in the courtroom? Is Mike Hawk present? Mike Hawk, now calling Mike Hawk, is Mike Hawk here in the courtroom?

Hotels are ridiculous for charges. Last hotel I booked charged me $130 for the pool bar. I wasn't at the pool the entire time I stayed. When I called the woman on the phone told me the name signed wasn't even close to my name, yet they charged me anyway. I guess they don't bother to check.Comment

Hotel employees know this as well.. and they all aren't mistakes..
There was a show on some years back about how some utility companies pad the bills of big corporations because they know that the customer will just look at the amount owed and write a check...
What secretary is gonna run out and check the meter to verify the amount of electricity used? or water.. or whatever..
If they are confronted.. "Oops.. our fault.. we'll credit it back."
Very seldom are they caught..

Seems to me if there isn't a video tape of Lisa herself standing at the check out desk attempting to use that credit card, there is no proof she is involved in any way. Even IF someone staying in her room tried to use the card ...it doesn't mean SHES guilty of anything, or had any knowledge of the event.
Hotels make mistakes..it could have been something as simple as an employee entering the wrong room number..there are a 100 different ways this could have happened.
I would say that Lisa has a very strong case for a defamation suit against Mike Hawk...I hope he has deep pockets because I have a feeling this is going to cost him many times more than $5k...The damage has been done..its too late to say "Sorry I made a mistake".Comment

Not sure how prevelant it is now with the net, but employees stealing wallets and attempting to put a charge on a card has been an old trick in the hotel industry for years. They see if the card still works, then go buck wild.Comment

Not really, even if it wasn't her.. the card was still used to pay for her room. So it is more than reasonable to assume she was involved, until proven otherwise.
Not saying she was, but as they say possession is 9/10th of the law. Being her room was paid for by the card in question, she was temporally in possession of goods paid for by a stolen credit card. So in all reality it's up to her to prove she had nothing to do with it.
If you had a laptop show up at your door from Dell and it turned out it was bought using a stolen credit card. Not likely that damages would exceed the 5k. And that would only be if she lost the booble contest.
Most lawyers will tell you that defamation suits are almost impossible to win. Yes, it is easy to SAY someone defamed you, but proving actual damages, which is what a lawsuit is all about, is VERY difficult.Comment

Actually, that is incorrect. We had a large package sent via UPS disappear a few years ago. I spent some time with UPS loss prevention trying to track it down. What I learned was that when an item is shipped using a stolen credit card, the #1 suspect is not the resident where the item was shipped but someone within a 2 mile radius of that location.Comment

You may be right..however I would say any reasonable person (see juror) reading this thread would come to the conclusion that her reputation has been damaged, the posts were made with malice and intended to do her harm and that its reasonable to assume that she will lose income due to this as well..beyond the booble contest.
