          Let me preface this by saying I hope the dirty fucks that produce and/or distribute and/or view CP get everything coming to their asses.

          However, constitutionally speaking, how are these requirements not a 5th amendment violation? I mean, in their comments, isn't the Department of Justice pretty much admitting that this requires people who are breaking the law to incriminate themselves?

                      It has nothing to do with it, other than it's going to own a large percent of webmasters / adult companies and I'll be happy to see it do so. Anyone who knows anything about business knows that type of an industry does not last. I know you're a straight up guy BoyAlley, but the large majority of this industry refuses to regulate themselves, promote content theft, skin, cheat and steal... and now it's about time to pay the piper.

                      I could retire today if I desired my little gay friend, but at 35 I enjoy my work and can't wait for the hammer to swing on this issue simply because there are more in the industry who give us all a bad name than not. If you only knew what I knew about what really goes on at some of the studios, you would also be happy to see them fall.

                        This is an update on the newly-released rules and regulations related to 2257. We will provide you with more information as it becomes available.

                        First, it is important to recognize that the regulations that the DOJ has set forth today are simply proposed regulations, issued for comment and possible change.

                        FSC will extensively comment on the regulations, and we intend to launch an industry-wide campaign to solicit your comments as well. We need your particihapahation in this process. In the coming days we will provide details on how to comment.

                        Some of the points set forth were expected, and they represent the modest gains that we have achieved through litigation thus far. Some of the other points are troubling and represent the intransigence which we have come to expect from Attorney General Gonzales and his associates.

                        On the critical subject of “secondary producers,” the Justice Department is continuing to suggest that it has been right all along and that Congress ALWAYS intended secondary producer to be included in 2257. Therefore, they are considerhaing the original legislation and regulations issued in 1995 to be valid for “secondary” as well as “primary” producers. We understand that for many of you it is simply impossible to comply with the Justice departments demands, and that is one of the reasons why we will continue the fight.

                        Unless the final regulations change radically from those proposed today, FSC will continue our litigation at the appropriate place and time, including seeking another injunction for “secondary producers” as well as others.

                        At the end day, we will make sure that federal judges understand the absurdity of these regulations, and we will not let up on our commitment to you and to your rights.

                                      I totally agree, man. Marketing and promotion - or even presentation in alternative formats (e.g. VOD, etc) should not equal production. Have an easy-to-trace standard paper trail between any content and the location of the 2257 docs - with sworn affidavits from the primary producers every step of the way, perhaps, and that should suffice, imho.

                                      Anything more does seem overly burdensome... especially if the whole thing's applied to only some people and not others. Point me in the direction of the "Adult-Content Only" drinking fountains, eh?

                                      I don't think they do. It's the legislators that are writing these laws, and have you seen some of them talk about pornography on the House and Senate floor? It's up to us to educate them, I think... and we do that by writing letters, and doing what we can to make sure that our industry is not singled out and persecuted separately from more mainstream industries that do the same thing we do.

                                      That's where this whole thing's taking a wrong turn, imho. Get all of Hollywood in the boat with us, and whatever happens happens. If things get out of control, our representatives are going to have a much larger squeaky wheel to deal with.

                                            1) This is the _RULE_ and NOT THE LAW!!!! Thats a DIFFERENCE everyone.. The LAW was signed in 2006 already! This is simply the rule and explanation that the DOJ writes up to define who the law is USED... Doesn't mean the law was not in effect 2 months ago as far as I understand... But maybe I'm wrong in this one, since I do not understand the US logic of what a "Rule" and a "Law" is... If you read the rule though, its really an EXPLANATION of it and NOT the law itself.

                                            2) The ISP provisions are NOT REMOVED! In contrast, they are MORE CLEAR and EXTENDED! As Elli posted, the rule states:

                                            2. Second, the Act revised the exclusions in the statute for the operations of Internet companies. Specifically, the Act amended section 2257 by excluding from the definition of ``produces'' the ``provision of a telecommunications service, or of an Internet access service or Internet information location tool * * * or the transmission, storage, retrieval, hosting, formatting, or translation (or any combination thereof) of a communication, without selection or alteration of the content of the communication.''
                                            It says "the [Adam Walsh] Act AMENDED section 2257 by excluding [...] telecommunications service, or of an internet access service or internet information location tool [...] or the transmission, storage [...] without selection or alteration of the content of the communication.".

                                            That means, it DOES protect ISPs and YouTube, Search engines, mySpace and so on...

                                            3) RawAlex is wrong stating:
                                            No, read through closely - they specifically killed that version of the ISP provision, and limited it down to only ISPs that don't edit or control the images in any manner. As Myspace and Facebook both do review and delete offensive material, they are in control of the content and therefore would no longer be exempt.
                                            The regulations state:
                                            [...] without selection or alteration of the content of the communication, except that deletion of a particular communication or material made by another person in a manner consistent with section 230(c) of the Communications Act of 1934 (47 U.S.C. 230(c)) shall not constitute such selection or alteration of the content of the communication; and [...]
                                            So the simply DELETION does NOT constitue SELECTION. Read 47 USC 230 here: http://www4.law.cornell.edu/uscode/h...0----000-.html

                                            Specifically 47 USC 230(c)(2)(A):
                                            any action voluntarily taken in good faith to restrict access to or availability of material that the provider or user considers to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected; or
                                            4) The "lascivious exhibition" definition is referenced from another child protection act, and thats why it keeps saying "child", it does not mean that this somehow only applies to pictures of actual children and if its not a child it does not have to be kept records for.

                                            Also, I am unsure here, but since it is a "List of factors for determining..." the meaning of "lascivious exhibition", I am unsure if (4) actually means to include "fully clothed" ones or if it just means that them being either fully clothed, half clothed or naked is one of those factors. If it meant that even fully clothed ones count, would it not make (4) useless since its nolonger "a factor" since ALL is covered by it?

                                            The other major thing here is what everyone keeps saying only applys to hollywood... Its the part that defines when records do NOT have to be kept for "lascivious exhibition" AND SIMULATED sexual conduct:

                                            (i)
                                            Intended for commercial distribution, (ii) is created as a part of a
                                            commercial enterprise by a person who certifies to the Attorney General
                                            that he regularly and in the normal course of business collects and
                                            maintains individually identifiable name and age information regarding
                                            all performers for purposes such as Federal and State tax, labor, and
                                            other laws, and (iii) is not produced, marketed, or otherwise made
                                            available in circumstances such that an ordinary person would conclude
                                            that it is child pornography.
                                            The point of this, as far as I see it, is not to protect hollywood! Its to make sure that recordkeeping for simulated and "lascivious exhibition" content is only required if you do not actually use this stuff commercially, its basically to fuck REAL CHILD PORN DISTRIBUTORS!

                                            This _MIGHT_ affected extreme teen sites though (because of (iii) of the exceptions)... For all others, you do pay your models no? So you have data for federal and state tax returns and such? So thus that content is STILL not covererd here, no?

                                                        There is a time and a place for everything. I'm quite sure this would be a time and place for addressing the issue at hand, which is the proposed 2257 regulations... not all the underlying faults or dark future of America.

                                                        And yes, I do agree that there is a lot wrong with the US. I can plainly see that as a citizen, and I don't need non-Americans to point out the elephant in the room. So thank you for your input, and I agree with much of it.

                                                        You certainly have the luxury of saying "deal with it", living in such a stellar country as Germany. For someone who's so aware of America's dark future, and the factors that may lead to it, I'm also confident that you're aware of the stigma that those who work in adult also carry. And also as an sympathizing human being, I'm also sure you're aware that most people would much rather not have their name attached to what they do.

                                                        You can cast judgment however you like. Critisize them for picking their profession and advise that they pick a new one if they're hesitant to disclose their identity in the manner proposed in these regulations; however the fact remains that we feel we shouldn't have to regardless of your opinion.

FSC is not going to resolve the situation with secondary producers. The real reason the secondary producer shit is now law is to cut down on a majority of the porn on the web. It is not to help them locate docs or make the paper trail easier for them. Because else, someone releasing child porn would not have to keep records since they simply uploaded it on their page, someone else produced it, and they have no clue who...

If you look at it from the perspective of standard porn and law abiding secondary producers, it is about porn and trimming the fat. They keep lumping us together with the real shit heads of the world and don't expect anyone in the mainstream world's sympathy on this. If you were in mainstream, would you really give a shit?

                                                                                I agree, the vagueness and confusion sucks... and its still vague with the new changes, it is getting better though...

                                                                                Hopefully now the FSC is going to attack the actual LAW and not that it is too vague and such...

                                                                                What I do not understand is, why not simply allow referencing the primary producer, it makes no sense that the records have to be kept in MULTIPLE places. It actually INCREASES the work the gov has to achive! If it were all only at the primary producer's location, then there would simply be a few hundred places to check documents at. Once they see that they already checked that producer and the content they do not have to check again.

                                                                                Now, they have to actually check THOUSANDS of locations from MILLIONS of websites... a LOT more work for the gov. Lots of more Tax $$ spent...

                                                                                    With all due respect, I feel that you are gravely mistaken if you believe that this isn't geared toward "honest" porn producers, whether in language or underlying intent.

                                                                                    2257 operates on the premise that child pornography will be thwarted by child pornographers keeping records of their own child pornography for Department of Justice agents to inspect... I can't be the only one that sees the absolute absurdity in that. It doesn't matter at what level this disgusting content exists: production or distribution. The very idea that they expect criminals to keep tabs on their own criminal endeavors is preposterous!

                                                                                    Since the flawed logic is as bright as the sun, the only other conclusion that we can come to is that this is a thinly veiled attempt to over-regulate adult webmasters and add an excessive burden that will ultimately limit the amount of pornography that is created and distributed in America through inreased expenses and a chilling effect through invasion of privacy.

                                                                                            Funny, this is even more proof that they are not working to get rid of CP or to protect children, but instead to randomly harass the adult industry. All of these things would be great items to bring in front of a court to show that the 2257 provisions of the Adam Walsh law were created NOT to protect children, but to impose harsh and burdensome rules on the adult industry with the intent to limit the availability of protected free speech.

But I know they select movies, watch them, and jot down who they want to see records on. So maybe there was someone who looked borderline.. Brooke Sheilds in "Pretty Baby" is effectively illegal, because there is no way to prove her as a model of 18 years of age when she made this movie, which shows "coy sexuality". It makes pretty much everything from Britney Spears to Mickey Mouse club potentially liable because their models are under 18.

                                                                                                    You actually did not get the point of this law. The point is that people that do child porn actually HAVE TO BREAK the law!

                                                                                                    This way, if its unsure if its child porn, like some girl that looks 16 but might be 18, or that looks 14 but might be 18, the records prove that she is 18 OR the fact that the records are NOT kept will get them convicted anyway although it can not be proven the girls is 14!!

                                                                                                    If the girl is obviously 10 years old, they do not even need this law.
