The use of double-opt-in emailing generates no "heat" as such. Will there be the occasional complaint? Sure and for a couple of very good reasons. People forget they signed up or they think that all commercial emailing is spam and get bitchy but the autoresponder records the email address, the IP used to sign up as well as providing a timestamp for the date and time of that signup. If you get a complaint from a host or registrar, we just send them the timestamp info of the opt-in and "Bang!"; the complaint is shown to be unfounded and the host or registrar goes away happy. The complainer's email address is then removed from the list and on we go!
There is no legal heat because the double-opt-in software meets the requirements of the CAN-SPAM Act of 2003.
