Asked the question on another thread.. but

Hi all, I asked this on another thread, but it never was answered, maybe no one knows, maybe it was missed in all the Frisky & choker madhouse stuff
Im wondering if camsite owners needs a licence for music played on the website or if the owner can be fined & sued for the models playing music without a licence?
I know that a public premises & anywhere using the music for part of the act or background needs a licence to play dvd, cd, or radio. If there is no licence they can be fined.

How does it work for the camsite owner if they have a model playing music from home or a studio, possibly without a licence. Would the site owner also find themselves in a situation, considering huge companies such as virgin or interscope, have enough money to sue?

Well, it's the kind of thing that you can do and get away with it for life.

But, if you ever make enough money that's worth taking
then you will not get away with it.

There was a YouTube case on this a few years back. The record label sued some chick over her baby dancing to some tune on YouTube. The record companies lost. I believe the verdict was something along the lines of........ the music was not the central theme of the video (the baby doing the electric slide was).

      So it was thrown out.

Key words are "jury", "baby", "mom" and "youtube".

Key words were not "jury", "porn", "cam whore" and "you".

So I buy the cd, download the mp3, whatever, and I can't play it in the background if I'm on the phone, webcam, whatever? Fuck that shit

Have gideongallery break out the VCR and Delorean so you can travel back in time for the verdict. On your journey, gg will break down the case for you complete with all of the legal this and that for your amusement. Citing case after case of time shifting while working the flux capacitor.

Nice one. Im glad they got away with it, as it seems like some fun & the women certainly wasnt making money out of them. With a camgirl poledancing, I suppose she is using her music to dance to, as background music, she may get away with it.

After hearing this, I think in our studio, we wont have music playing unless its our own.

If you make money off people while they can hear the music, you are asking for trouble.

At least knowing the music industry with their overzealous lawyers

here is the UK Performing Rights Society page, it can be big bucks for shops & public areas to play music without licences....

There's a number of different licences and organisations in the UK that covers this. You need to make sure you get the right one.

With all the 'fans' you have, you need to get it right, in case someone grasses you in to the Dorset police.

I am covered for stuff I do through http://www.theiac.org.uk/, but I don't think they cover any commercial use.

Best thing to do is work out a license deal.

Yes you can be sued, by a company with a lot of money to spend on lawyers. Win or lose, you lose.
