On and between October 1, 1983 and January 31, 1984, in the County of Los Angeles, the crime of LEWD ACT UPON A CHILD, in violation of PENAL CODE SECTION 288(a), a Felony, was committed by Maximillian Rudolf Lobkowicz, who did willfully, unlawfully, and lewdly commit a lewd and lascivious act upon and with the body and certain parts and members thereof of Danielle L., a child under fourteen years, with the intent of arousing, appealing to, and gratifying the lust, passions, and sexual desires of the said defendant(s) and said child.

There is independent evidence that clearly and convincingly corroborates the victim's allegation, to wit, audio tape of defendant's admissions of allegation.

From taped calls between Danielle and her daddy Max:

D: "I'm just trying to understand... I have kids of my own now. If anyone touched my kids in that way, I would kill them. I need to understand, maybe where you were. Were you going through a lot..."

M: "Unless I have lost my memories, I never touched you. I may have held you. I may have spanked you.

"You know what I do for a living?"

D: "There were several instances at Ellen's [Mickey's wife at the time], I used to come over all the time, we'd get drunk and have sex."

M: "I remember there was the one night we got drunk and maybe it happened more... We got drunk and we were sittin' and laughing and so forth and at a certain point you said to me, "Do you want head?" And so you gave me a blowjob. I remember that vividly."

D: "Remember and mom [Ellen] kicked me out and I went and slept at your house that night...and that's when we had sex that night."

M: "And that was the first time?"

D: "I don't know."

M: "No. Because I remember the first time. You were... The first time was in your bedroom, the small bedroom to the side and we'd go sitting at the edge of the bed. At the penthouse. The one you used to come to. Gorham."

D: "I know that the first time..."

M: "We had sex."

D: "Which time was that?"

M: "I got you that place one bedroom studio place. You were either 15 or 16.

"Now aside from you being my daughter, to me that's not a bad age of consent.

"There are two way streets. I never thought of you as..."

D: "I wanted your attention and that was the only way that we had any closeness. I did consent to it, to all the things we did. You're my dad and I wanted to make you happy."

M: "You had a lot of parents. It was very communal."

Max's daughter Danielle Cherie Leblovic said the molestation began at 16012 Moorpark St. #201, in Encino, CA.

Salinas Police Department. Officer Ono Solis writes:

On 5-30-00, I was contacted by Detective Nelson [DOB 1/8/72] of the Los Angeles Police Department regarding this case. Detective Nelson advised me that she was looking into this case as it appears that the offenses alleged by the victim in this case, Danielle Leblovic, occurred within the jurisdiction of the LAPD.

Detective Nelson...asked if I could arrange for the victim in this case to make pretext phone calls to the suspect...Maximillian Leblovic [DOB 11/8/43].

On 8-24-00, I met with Danielle at her residence to conduct the first pretext phone call. Danielle...attempted to talk to Maximillian about some of the sexual relationships that they had when she was a child.

Maximillian did not admit having sexual relationships with Danielle, however he did talk about an incident where he said he was a victim of being sexually abused when he was a youngster. Maximillian went on to tell Danielle that...he was sexually abused by a high ranking member of the military.

Maximillian went on to tell Danielle that he wanted to tell her how he felt about this situation. He went on to state that he was actually "proud" that this high ranking military official chose him over some other child to perform the sex acts on.

Salinas PD officer Tiburcio Gomez writes:

I responded to the front lobby of the Police Department to contact the victim [Danielle] Leblovic...[who] indicated that while growing up she had been molested by her father, Maximillian Leblovic de Lobkowicz. She indicated that initially she had been molested at the family home which was in the Los Angeles area [16012 Moorpark St. #201, in Encino]... This initial molestation had occurred to her by a friend of her father's. She advised that when she reported the incident to her father, that her father indicated to her that it was OK, that it was nothing wrong, and that she should forget about it.

A few years later her father was apparently arrested and sent to prison on pornography charges. She indicated that apparently he was publishing a pornographic magazine at the time, and that he had used underage models who posed for nude pictures and was set to publish them in the magazine when he was arrested by the police. He was subsequently sentenced to 18 months in prison.

Leblovic indicated that her father got out of prison when she was 10 years old. It was at that point that the molestation began on her. She indicated that shortly after having gotten out of prison that he, along with her mother, herself, and her older brother, had moved in with her grandparents. She advised that her father had only been out of prison a short time when he called her into the bedroom, and began to fondle her...had her perform oral sex on him. She indicated that he ...would "eat her out" also.

Leblovic indicated that by this time she had been made aware that this was inappropriate behavior, and informed her father of this. He, however, told her that the American public "did not understand." He told her that this was acceptable behavior in many countries, and that it was just the American's attitude towards sex that cause them to try to make this a bad thing. He also indicated to her that this was just a form of affection, to show how much they loved each other.

Leblovic [said] that this type of occurrence continued...on almost a daily basis. Due to her fear that her father harming her if she told anyone she did not report this.

When she was 11, they moved to a separate residence away from their grandparents. Her father had less time to spend alone with her and the sexual activity slowed down to once or twice a week. It continued to be the same, no actual penetration on his part, just her performing oral sex on him, and him performing oral sex on her.

A short time later, when she was approximately 12 to 13 years of age, her father began to have sexual intercourse with her...once or twice a week.

During one of their sexual encounters, her stepmom Ellen Leblovic walked in. A large argument ensued. Ellen broke a vase over Max's head.

After this, Max took Danielle on trips. Most of their sex occurred in hotel rooms.

She started running away from home. The last time they had sex was when she was 17.

She returned to LA at 19. Her father immediately tried contacting her and telling her that they should get together and talk about old times and that they should reacquaint themselves. She told him she would not meet with him.
