Drive away and leave the guy there or shoot him. He can't leave. If he leaves and that guy hurts someone else he would be torn apart for it and people would be in here saying, "What, fucking cops just leave and let these guys attack other people?" So the leaving option is off the table.

If the guys is attacking a police car with a bat he is clearly out of his mind. I would imagine if you just sit there he is going smash your window in and bash you in the head. That bat is a deadly weapon. The guy really only had one choice. It is easy to second guess it now, but when you are in the moment and have two seconds to make a choice, it isn't so easy.
