What I don't understand is how you can even go after someone who a) no longer lives in the United States and b) runs a company that is not a US based company. Remember recently he closed up shop in the US and broke off all business ties with the US. His business is now a foreign corp.
So how can you in US courts go after this person?

Who said anything about filing a lawsuit now? So we should wait until after Oct 18th to start collecting data to even see if a lawsuit is feasible? First off all, I am not a lawyer, don't claim to be, but have been in the courts many times.
I also have witnessed crap like this go down a million times and I disagree with the waiting until the 18th.
First off all the longer you wait the more time you give them to dig themselves in, and the harder it is going to be to get a dime out of them period.
Second: Why wait because Epass said so? It is your money so you decide when and how you want it. I'd say the time is now.
Collecting evidence? Well lets see:
Statements are gone(Though they are obliged by law to keep them) withholding them from you is a crime. I agree it is your responsibility to download/print them but they have the obligation to make them available and if they are going down they are obliged to give notice in order to provide you with the chance to download/print them still.
On October 7th Epassporte NV was dissolved. No warning, no message, gone, just like that. If that does not make you see the writing on the wall, I don't know what will.
Wires deducted from the wallet amount never arrived(Read were obviously not sent). This shows they had no intention of sending them out.
ACH stopped the minute they put up the message they closed. No advance warning, nothing, yet ACH underway never arrived(Read were not sent.)
Now they have a message on their front page about disclosing something on or before the 18th, are vague about what is disclosed, in other words stall tactics.
If the above does not get your ass in gear, and I mean right now, you will be in for months if not years in court, and even if you win the chances of ever seeing a dime are about zero.
My take on the matter. I have no interest in this matter at all other then I said they were crooks from the start, they fucked you over then(Epoch). They are fucking you over now(Epass Drama), and if you wait long enough you are going to get fucked over again(At the courts).
Two out of three times I have been right already the third is a prediction. Will you prove me right on that one too, or will you finally wake up and smell the coffee?
Sheesh sorry to rant like that, but this was starting to annoy the shit out of me.

I believe you are correct that by law, they are obligated to keep their records and not destroy or tamper with them. If evidence of this is found, then it possibly becomes more than a civil case, and is now also a criminal case, meaning that Mallick and others might be looking at some serious jail time.
Be sure to go after the bank, and all of the people that were involved with both ePassporte and the bank which is involved in all of this as well (Gregory Elias et al, United International Bank/Trust, NV, etc).

Personally, those getting in on a class action will NOT recover their money. Those whom win in a class action are the one whom initiated it and the legal team, the rest will get peanuts.
You're better off filing a separate and individual suit to recover actual damages + legal fees since a class action will not get you your money back.Comment

If anyone else is afraid that Epassporte will recognize your country and exact amount and trace it back to YOU then round off what you have in epassporte, it does not have to be exact exact amount. I have 7k in epassporte myself, I am risking losing it all by making this site, but you know what? I had full faith in epassporte until the day the ach depsoits stopped working, and I based my decisions to keep accepting payments up until the end in large part due to Michael O's reasurances that wallet funds would be paid out. I feel like the guy on the Titantic reasurring al lthe guests that the ship would not sink becasue the Captain told me it wouldn't.
