More hypotheticals DH??
Never mentioned porn laws or hypothetical stuff about hosting - did you??
Tho we did get an explanation about child offenses - which could not hold up
And also how you were liable for the laws of other countries....Last edited by Webby; 04-17-2007, 05:16 PM.XXX TLD's - Another mosquito to swat.Comment

If we are talking about porn laws, and I don't host porn, kindly explain how those laws apply..Do I give a shit where your customers are? The issue was raised by you and where you ultimately claimed you were subject to the laws of other countries and were in compliance with their laws... DUH???
Obviously if you operate a business on the net - you will be trading internationally. Do you operate a biz or not? You sure stuff enough referral links in your posts

Did I even refer to what you are hosting??? When was that??
You may have forgotten, but you kindly volunteered to operate under the laws of other countries and (wrongly again) - assumed "foreign webmasters" were bound by the laws of the US? You changing this yet again?XXX TLD's - Another mosquito to swat.Comment

Some of these foreign webmasters are tough nuts.
They love our American dollars, but they hate our leaders and they hate our laws, and sometimes they just seem to hate hate hate..Comment

Why are you splitting hairs? Are you that far backed into the corner?
A webmaster is person who hosts porn, right?Comment

You got an opinion on "foreign webmasters' next??
No.. "we" don't love your dollars - they are shit (in case you never noticed)...

Well if the laws say what has to be done when one is hosting sexually explicit material, and the particular fact pattern is where one is not hosting sexually explicit material --then it's pretty clear to me that hosting plays a critical role.
Do you understand the difference between hosting sexually explicit content and merely linking to it? Do you understand the difference between telling your shop customers to go buy Playboy next door at your friend's shop, versus stocking it on your own shelves?Comment

OK.. Gonna try and be serious DH - tho it may be hard to keep a straight face - it's GFY
OK.. we are talking about hosting sexually explicit material??
What laws are you talking about?? US? If so, sure, there are laws covering both these aspects.
Yes thanks, - understand perfectly on "linking" and otherwise. Those laws do not apply to me or webmasters outside the US (but excluding the usual CP related linkage which is not normally associated with the "adult industry").
Sorry.. I don't sell Playboy nor do I stock it
What exactly is your point DH?? Skip the preliminary bullshit - I've been in this biz longer more days than you ever had breakfasts - cut to the point please.Last edited by Webby; 04-17-2007, 05:44 PM.XXX TLD's - Another mosquito to swat.Comment

I made my point early on. Re-read if necessary. Sorry for failing to give you chapter and verse.
More recently, I have just been responding to you blowing smoke up my ass.Comment

Ah.. basically there is no point? Okkkkay!
First you claim the world is obliged to operate under US laws.
Then you moan US citizens can be prosecuted in the US for offenses against children while on foreign soil, where, according to you, it is legal to fuck children.
Then you try to associate the gaming industry with your perceptions of international law, when in fact the US is currently in violation of international treaties (WTO)
Then you introduce some vague chat about "hosting", "linkage" and "sexually explicit" content - which has little to do with international law, child offenses, gaming ad nausea.
DH... Can you get your brain in gear before offering "opinions" - and try really hard to have a clue of the subject matter before placing your fingers to a keyboard?
Many thanks!

I'd sure hate to be a lawyer having to suffer you as a client DH
The legal team would be left wondering what the hell they supposed to be defending "It's a cross-border issue?" Nope. "It's about child molestation?" Nope. "It's about "sexual linkage"??" Nope. "It's about the laws of the US internationally?" Nope. "It's about hosting??" Nope...

Webby,
Let me sum it up for you in one word: 2257.
But, it may be more far reaching. Consult a lawyer to be sure.Comment

OK.. Will try and treat this seriously DH..
What about 2257? This is a US domestic law which has no validity outside US jurisdiction. It is not a law which falls under any international treaties or agreements. It is simply a domestic "record" law designed to ensure the US industry does not engage individuals under 18 in a sexual context. (Tho in practice, it's already known this is pointless and resources would be far better directed towards the high amount of "actual" CP on US servers).
What where you thinking of 2257 in a "far reaching" context?XXX TLD's - Another mosquito to swat.Comment

Why do you keep asking me for legal opinions?
I am not a lawyer.
I cannot lead you to the destination, I can only point you in the direction.
That direction is this: non-US webmasters with US customers need to comply with 2257. That is according to a porn lawyer. That is all I can give you. The rest you must get from a lawyer.Comment

OK.. You have answered after listening to a "porn lawyer". Bottom line... don't daydream and tell your lawyer the same - and give thought to getting better legal advice

I don't offer ANY legal opinions. I am not a lawyer.
Is the responsibility of foreign webmasters to comply with US law far larger than merely 2257? I DO NOT KNOW. Let me repeat: I do not know. That is what "may be more far reaching" means. It means you need to get your own legal opinion from your own lawyer to know for sure.
A lawyer at the show said something, and I am repeating it on GFY. If you don't think it is worth anything, that's fine. He appears to be very knowledgeable though. See his website here:

2257 exists alright. You can find it in the US code book under.. 2257.
The reason I did not originally refer to a specific law is that the compliance requirement may not be limited to that particular law. There may be multiple laws. That is why you need to consult a lawyer.Comment
-
That is already more than clear.
What you are saying now is a total contradiction where you claimed earlier that "foreign webmasters" are subject to US law. Now you "don't know" - with the further comment that I supposed to seek a legal opinion. Is the responsibility of foreign webmasters to comply with US law far larger than merely 2257? I DO NOT KNOW. Let me repeat: I do not know. That is what "may be more far reaching" means. It means you need to get your own legal opinion from your own lawyer to know for sure.
I don't need a legal opinion thanks - there is no doubt whatsoever that US does not apply to any other country - it never has. Each nation has their own laws and don't need the "help" of the US in this area.
You rely on soundbites from a lawyer at a "show" and then attempt to repeat this as law on GFY?? I'm sure the guy is knowledgeable, but don't assume so much and take every word he utters as being caste in stone.
I got more lawyers around here than mosquitos and live almost half of each day in their offices (tho most of that is not wasted on stupid adult-related bullshit).
I also know that US law (same as German law, Italian law, Icelandic law), does not apply in any other jurisdiction - it's too laughable - and no judge either in Latin America or the EU is interested in listening to the ramblings and assumptions of a legal mouth in the US.
Seriously... na... speechless *lol*
PS I'd really like to meet this guy face to face - if he spews as much garbage as you have suggested, it's going to be fun time *lol*XXX TLD's - Another mosquito to swat.Comment

Fine... but that applies to you - not to any other party based outside US jurisdiction.2257 exists alright. You can find it in the US code book under.. 2257.

Instead of making claims as to the relevance of US law, why not discuss the laws of Germany?? Nobody cares about US law or German law if they do not operate a corp in either of these countries.XXX TLD's - Another mosquito to swat.Comment

Oddly dear Splum - the legal system here is far advanced of the US, but that applies to "democracy" as well. Tho they had enough time to get their act together - and it can still be pedantic - but sure is refined.XXX TLD's - Another mosquito to swat.Comment

I would think they would be to busy working on murders, terrorists, theft, political coruption and things like that nature, than waisting their time surfing this board. I would hope so anyway, i know I pay lots of taxes and if that money is going to fund feds surfing industry boards, than my money is being wasted big time.Got Dating Traffic?
