So, are you suggesting that the existence of the internet has eroded international boarders?
It?s an interesting question when you consider that Western companies use sweatshops to manufacture goods while sweatshops remain illegal in the states where these companies are located.Comment
-
It's not my opinion. One of the attornies at The Phoenix Forum said that foreign webmasters doing business in the US are subject to our law.
Ad hominem only shows the weakness of your position.Comment

"Translated from Latin to English, "Ad Hominem" means "against the man" or "against the person."
An Ad Hominem is a general category of fallacies in which a claim or argument is rejected on the basis of some irrelevant fact about the author of or the person presenting the claim or argument."...

As a non-lawyer, sure I would suggest that. There is probably a ton of law to back it up too.So, are you suggesting that the existence of the internet has eroded international boarders?

But, it goes way beyond just the net. For example, US citizens can be prosecuted for travelling to foreign countries to have sex with minors, even if the sex acts are not illegal in the country where they take place.
Making clothing is not generally considered to be a hated industry on the short hit list of law enforcement. Adult ---surprise -- IS.
Ours is an interdependent globally connected multi jurisdictional world. Wake up to that reality, or prepare to pay the piper for his lullabies..Comment

I personally don't give one flying fuck about the "opinion" of an attorney at the Phoenix Forum - tho, if he did say "doing business in the US" and not, as you have previously tried to claim, "doing business with the US" - he is correct.
Obviously there are considerably less "foreign webmasters" doing business in the US - there is no benefit and more a liability than anything - so no biggie.
The stupid claims you previously made that foreign webmasters are subject to US law because they do business with the US is beyond comment.XXX TLD's - Another mosquito to swat.Comment

For the purposes herein, "with the US" and "in the US" are the same thing.
OK, let's get a real legal opinion, and let's see which one of us is "stupid."
Put up --or shut up.

Stick to being a non-lawyer
Why you think that is??? It is a criminal offense idiot. It is also covered by various international conventions.
Don't tell me... can't wait to hear what countries you can fuck kids and it's actually legal
Even heard of the Convention for the Rights of the Child?? The only country on the planet who cannot offer their children the same rights under this charter is the US - bad example using child abuse to excuse your stupidity on international jurisdictions.XXX TLD's - Another mosquito to swat.Comment

I should really add that quote to my sig -
"According to the braincell of DaddyHalbucks - For the purposes herein, "with the US" and "in the US" are the same thing."
Like this idiot has one clue

PS And what US law are you quoting from exactly?? *lol*Last edited by Webby; 04-17-2007, 12:30 PM.XXX TLD's - Another mosquito to swat.Comment

Let me re-phrase this, to be 100% clear, so your pea brain can understand it for sure: if you are doing business "with" the US, you are deemed to be "in" the US as far as your obligations to comply with US online pornography laws are concerned. I imagine the same legal principles apply to online gambling.Comment

You may think so and that may be your "opinion" - but that never did matter.Let me re-phrase this, to be 100% clear, so your pea brain can understand it for sure: if you are doing business "with" the US, you are deemed to be "in" the US as far as your obligations to comply with US online pornography laws are concerned. When are you in compliance with the laws of any other countries when you take a signup from them?? Never.
It's based on the principle of "international jurisdictions", but doubt you have a clue on that either. Odd that all other countries understand this concept which has been in existence long before the US was ever heard of, but a few stupid American's don't quite get it yet
OK.. On gambling... another bad example, and where the US assumes much which does not exist, - and in the process is currently in violation of WTO rulings. Can you get your house in order first before commenting on other nations? Thanks

You gone quiet for a moment DaddyHalBucks?
Gotta be studying law again...
So can you expound on : -
(a) Which nations can you fuck kids because it is legal.
(b) Produce any legislation to support your claims that "For the purposes herein, "with the US" and "in the US" are the same thing." I know you are quoting law here - just wondering which law
(c) What country laws you are complying with when dealing with these countries on the net? After all, it's common courtesy to comply with the laws of the countries you are taking money from? No?

Federal agent's for sure browse, read, and even quote people from GFY and other Forums around the Internet.
I was quoted in a FTC case in 2005 and the comment was made here on GFY.

A. None, as far as I know. And that's a good thing. The point I was making is that you don't need to be physically in a jurisdiction to be subject to its law.You gone quiet for a moment DaddyHalBucks?

B. I was quoting an attorney at the forum. I can't give you statute and section, but neither did he at the seminar. I suggest you get a real legal opinion if you doubt my retelling of the story.
C. The point is not me personally, but in general, of course, I am subject to all applicable laws just like anyone else.Comment

Why some people think federal agents wouldn't read here is beyond me. Of course, they do. It's a wealth of info for them as well as for us.
Heck, I wouldn't be surprised if some well known nicks were agents.Comment

When are you going to quit giving legal advice??
So basically you are saying there are no laws which allow fucking children.
Unless anyone operates a corp or some form of business, or actually resides in whatever country - they are not obliged to pay any attention to the laws of any other country. There is only one set of laws which apply - those of the country in which you reside - no other.
(And.. to stop the side deviations and cherry-picking... there are international agreements covering certain laws and these many be recognized by a group of countries and, in that case, you are subject to those laws. Further... those laws quoted as the basis of international agreements/treaties must be actual laws in the participating country.)
Quotes from an attorney at a forum are not valid - talk is cheap.
Agree.. a legal opinion is warranted and I have more than enough of them to have a clue - thanks. You talk shit.
You are? That's awesome that you are in compliance with the countries you deal with and subject to their laws - pity you have no clue what these laws are

Do I give a shit where your customers are? The issue was raised by you and where you ultimately claimed you were subject to the laws of other countries and were in compliance with their laws... DUH???
Obviously if you operate a business on the net - you will be trading internationally. Do you operate a biz or not? You sure stuff enough referral links in your posts

International Public law, every convention and every protocol is a MUST for every country in the world, or else there will be sanctions against the country who didn't respect the conventions and the protocoles! So the goverment assures that those conv. and protocoles are being respected, by accepting them as their own law...So hard to explain in english
