I would like to step in on this and say I think yes this banned guy was stupid for accusing someone in the first place as he did however lets all take a look at the mentality of such an accusation here.
There is an old saying" it is easy to point a finger".......
I only hope for everyones sake that they know they are playing with a lit can of gas with this type of legal but questionable content.
If you like living on the edge then by all means take the rope that has been thrown to you and wrap it around your neck.
Is it really worth the risk?

Lupe is one of the most popular porn stars in Spain. Adult magazine covers do stories on her. She has done adult dvds ect...
I made a deal with her and she was way down for her site.
Now I remember this discussion in 2004 when April came out. Still one of the most sold teen sites today. Lupe may past her. She is 4'11" 20 years old and ya thats the way she looks. No laws broken here.[Comment

(8) (B) such visual depiction is a digital image, computer image, or computer-generated image that is, or is indistinguishable from, that of a minor engaging in sexually explicit conduct; ....
(11) the term ?indistinguishable? used with respect to a depiction, means virtually indistinguishable, in that the depiction is such that an ordinary person viewing the depiction would conclude that the depiction is of an actual minor engaged in sexually explicit conduct.

This being the case, it could be considered cp if the powers that be decided to make it such.. I'd say a rather large gray area in this particular situation..

Someone else (maybe Mr Cummins) will be able to point you towards the judgement that rendered the "looks like a kid" thing moot. That is why you can dress girls up as schoolgirls, have them licking lollipops, and playing with stuffed toys. None of that is against the law.
As for this site, if anyone had spent a minute to read the 2257 page, you would see that some of the content goes back to 2005. She isn't just 18, she is more like 20 or 21.

Personally I don't give a shit about any laws on this subject - the fact is the site operators are pandering to a pedo market and are fully aware of this.

Quick lesson....
When you take a pic with your digital camera, you have created a digital image..
It has nothing to do with Photoshop unless you want to edit that image..
As for the, "looks underage" part.. As I said in my initial post... In this case, there can be quite a gray area.. especially nowadays..
I have no doubt that the gal is of age.. but she's definitely one that could draw lots of unwanted attention.. IMOComment

Pandering to pedos is no different from shooting pedo content - it is fundamentally pedo-orientated in substance and hiding behind laws and "making it legal" is attempting to stretch legal boundaries in almost all western countries.
In several countries, there are laws prohibited using models dressed as kids and this is inclined to attract attention (from the wrong places) and possibly result in legislation change - simply because of a desire to profit from pedo-pandering ("but I'm legal!") could not be resisted by a small element of "webmasters" lacking judgement. Idiots like that have screwed this biz over decades.
Personally.. I got no problem seeing their alleged "Custodian of Records" being evicted from his hideaway in Aruba - they don't bother about the niceties of USC 2257 or any other legal bullshit.XXX TLD's - Another mosquito to swat.Comment

Webby, let me tell you a funny sort of a story.Sheesh.... just followed some links from alleged "webmasters" promoting this pedo-fantasy pandering bullshit and almost of the verge of supporting legislation to kill it and throw the asses in a jail cell.
Never thought in well over 3 decades in the adult industry I'd consider supporting a censor-curbing operation - but obviously the standards and judgement of a few idiots in this biz have reached an all-time low
Back about 2000 or so, I was working at an Adultdex show at the Tropicana. Across from our booth was the booth for FSC, at the time with run by Bill Margold. Anyway, besides their usual run of T-shirts and pins, they had also set up a "massage by the minute" area. Anyway, the show opens, and in comes Bill with this almost elfin girl by the name of Maren. I actually asked Bill how old she was (he laughed but wouldn't tell me). Turns out her full name was Maren Beautte, and she had made many porn films, mostly in her native Germany. She was a very, very petite girl.
Yes, for a minute, when I first looked at her, I saw petite and saw "young". The reality is that is more than of age, and very experienced in the adult industry.
Does her appearance (at the time) appeal to the pedos? I am sure to some extent it would.
However, the law is the law, and there you go. You cannot deny a petite girl the right to work because some dumbass might get excited thinking she is underage. On that level, you would have to ban the Sears catalog for showing kids in underware, and so on.
I personally think that some of the more extreme sites out there (not in the teen market) may pander to rapists and abusers. However, as much as I would like to see some of those things go away, as long as their is (a) a buyer, and (b) a way to pay for it, there will be sites to sell it.
So don't worry about it, move on, and if you don't like it, don't sell it. Simple, no?Comment

Hear ya Alex... can give you plenty other examples of .... "small girls" who sure look young (but are over 18 - some a good bit over 18) and they have worked in the adult industry - and a few continue to do so now. However, the law is the law, and there you go. You cannot deny a petite girl the right to work because some dumbass might get excited thinking she is underage. On that level, you would have to ban the Sears catalog for showing kids in underware, and so on.

It is very hard to say the content of em was "pedo-orientated" - at most, it had a "young look" or, to use our industry euphemism - teen.
With a decent stylist, you can take a model and make her *anything* for a shoot - she can look like 25, 12 or 30 something and the "presentation" can, again, be anything you like. I've had a 20 year old mocked up as 50 (not for adult!! *lol*)
The "small" models on the books were never "styled-up" and shot to look like kids for hardcore porn sites. Won't pull some pics to demonstrate this - but it is more than clear that the shooter took these images at angles which emphasised the "smallness" of models and with a view to pandering to a pedo market (great what a wide lens and a downward angle can do). Take the complete content and keep it in it's context (something any potential prosecution team would love) - and there is no doubt whatsoever that it is pandering to a paedophile market Hell.. even the text/sitenames are pedo-pullers.
On the concern over models - I've never known a model to loose her cred or work opportunties because she missed out in appearing as a kid on a website specifically designed for a pedo market appeal.
This content is, at it's best, bordering on illegal in a few western countries, (it's up to a court to decide). Because something is not technically illegal ("I can prove age!!") does not mean idiots should have a free reign to fuck this industry up further.
Irrespective of that and any laws which happen to exist or otherwise - there is no doubt this load of shit would result in a rapid eviction from any corp base in Aruba - others have been thrown off the islands for far less.
Sure there will be buyers and sellers willing to engage in actual and fake pedo content - the real mob end up in a jail cell - the others get the attention which is warranted and usually end up screwed and leaving a trail of bad news for the adult industry behind em.
It's all a matter of judgement - webmasters are responsible for *any* content on their websites. It's clear this judgement is a "little" deficient - being "technically correct" in a few countries does not make is "legitimate".
Na.. Never have engaged in selling pedo-fantasy porn - I'll pass on this shit

Webby, here's the problem: since there is no way to draw a line on what is "pedo fantasy" the reality is that the line is drawn with the model's ID. Age 18, good, age 17, 364 days bad, and that is that.
There are plenty of girls between 16 and 18 who look totally adult - should we then say "well, they look old enough, so it's okay to put them in porn"? The obvious answer is no, because there is a set standard.
In the end, if you don't like it, don't promote it... but don't cry because it doesn't match up to your particular moral standards. As long as their is both and audience and a willingness by the credit cards companies to process for it, there is a market that will be tapped.Comment

There is no problem. Pedo-orientated shit is just that. It's not a matter of debate or worth defending. It's not a matter of age - it's already known the girl is of legal age, - it's a matter of pedo-marketing.Webby, here's the problem: since there is no way to draw a line on what is "pedo fantasy" the reality is that the line is drawn with the model's ID. Age 18, good, age 17, 364 days bad, and that is that.

At what level would you suggest this industry take pedo-marketing? Sure.. some folks would sell their grandmother for a dime - excluding them, shall we dress up 21 year olds to look like kids of 12 and stick a cock in their mouth and one up their ass to pander to the expanding pedo market in North America?? Has the Asian and Russian content sources dried up so much that the main-line adult industry feels an "obligation" to market to sickos??
This industry constantly expresses wishes of not being associated with pedo-orientated sites/material - BUT... of course, if there is a buck to be earned the idiot element can be relied upon to go that path - that makes it OK.
As you said... "As long as their is both and audience and a willingness by the credit cards companies to process for it, there is a market that will be tapped." Basically - if there is a dime to be earned and it appears legal in the eyes of US law - sure, let's all do it - just because we can.
The "set standards" may be those you elect to operate under - they are not necessarily the same as other jurisdictions or other people. Live with it.
Think I already said about promoting it?? I don't market to pedos.
BTW .. Don't worry about matching up to my moral standards

In Canada it's illegal even to imply. If the model is 50 and you dress her up in pigtails or put her in a childlike situation, it's cp, no matter how wonderful your records are or how obvious it is the girls is of age. Not sure if you know why, or if you remember why, Canada introduced legislation to cover this angle, but can remember it was introduced elsewhere specifically because a small element of the industry (not the online industry - it was before that time) started stepping over the line and portraying "kids" in porn magazines - actually adults "portrayed" as kids - which is exactly the scenario with this sponsor.
Sure.. it may be technically "legal" according to US law - tho the US remains the only country on the planet which does not offer their own children basic protection under the Convention on the Rights Of The Child, but it sure is not "legal" in Aruba - the law/justice system there will not be bothering about the finer issues of age or USC 2257, but more likely to kick their asses/corps off the island or more serious.
It's hard to defend the adult industry when an element of that industry is engaged in marketing imagery/content which is clearly designed to appeal to individuals with pedo tendencies. This is not exactly, as was suggested earlier, comparable with content from a Sear's catalog which may appeal to a pedo element - it's hardcore porn. Don't think Sear's publish much hardcore material :-)XXX TLD's - Another mosquito to swat.Comment

I do remember it..the reason I'm so aware of the laws was that while the legislation was being revisited, our lawyer was in the thick of it and keeping us abreast of where the chips finally fell. It's funny a lot of people want to come to Canada to shoot contnet because they think it's the cornucopia of models and lax laws up here, but oftentimes our laws are more restrictive than even the US laws. People just don't bother to do the research on it, and a lot of people up here shoot stuff that is clearly way over the line. Unfortunately for them and everyone else in the industry here, eventually it will come back to bite them in the ass..... Especially with a Bush-asskissing conservative in power at the moment.Sounds much the same as a few other countries LadyM!
