the purpose of the safe harbor provision is to protect free speach.
i have a fair use right to use your content for parody, commentary purposes. without the rules free speach would be censored, and if the choice is between free speach and extra profits from a government granted monopoly, fuck the monopoly.

bullshit shoplifting is not legal, there is no free speach that needs to be protected in the case of shoplifting.
the item is gone from the store so someone who would have bought it denied that ability.
