if you buy the theme, remove the links. Your not being forced to pay AND leave their link...it's your site, put your own footer links.

Its says the author is http://newwpthemes.com/

I have already contacted them but have not got any reply back

It does say that you should keep the footer links intacted

I don't think there is a premium version of the theme, that is a free theme.

You should have emailed him and said "I'm using your theme on a gay midget fisting site, and would like to remove the link, is this a problem?". They usually say to go ahead.
