Will Stagliano case finally force a true definition of obscentity?

    Will Stagliano case finally force a true definition of obscentity?

    I think it could but is that really what adult wants? What if the new definition defines as any penetration as obscene, taking it out of future jury's hands, essentially creating slam dunk cases? Is this a good or bad thing if they end up redefining?

    I know many of us have said we want it defined legally so we are aware of the boundaries when dealing with our freedom but what happens if they redefine in an archaic sense? Common sense would say that most garden variety porn would be safe if they addressed refining the definition but then again, common sense thought a jury in the Max Hardcore case would acquit him of sending through the mail when the distributor was the actual shipper and Max had no control of the shipment.

    I am curious to what others thoughts are. Could adult as we know it come to an end this summer?

          Stagliano, a donor to the Reason Foundation, which runs Reason magazine and this site, could stand trial this summer along with his company, Evil Angel Productions. However, Leon indicated the defense could appeal his Wednesday decision to the U.S. Court of Appeals for the D.C. Circuit, saying, "This is about the overarching legal issue in this case, and needs to be resolved one way or another."

          This could be an avenue for addressing the question of whether a community standards carve-out made when porn was still shown in downtown movie theaters is applicable to an era when porn is consumed at home with the blinds drawn. The right to privacy derives from technology, starting with the ability to build houses with separate rooms. There's no reason it shouldn't be expanding as technology advances.

                On April 21 John Stagliano, one of the biggest names in adult entertainment, will be arraigned on seven federal obscenity charges. For those that have not heard about this case, on April 8 Mr. Stagliano was charged by a federal grand jury with seven different obscenity charges related to operating an obscenity distribution business naming two movies, Jay Sin's Milk Nymphos and Joey Silvera's Storm Squirters as well as Belladonnas movie trailer for Fetish Fanatic 5. Not only are charges being brought against him, but against his business John Stagliano Inc. and Evil Angel Productions. If, at the end of this case, it is deemed that Mr. Stagliano is guilty, he is looking at around 32 years in prison and seven million dollars in fines.
