    just got served today- unreal

    god I LOVE stupid lawyers

    i'm in bankruptcy!

    first rule in suing someone civilly, there must be a chance of getting something!

    it's for a shooting in my bar - before i owned the bar i owned the building and a tenant ran the bar - i inherited the tenant - and they had a shooting.... it was OUTSIDE the bar and on the street....

    i evicted the tenant for not paying a month after that happened.

    they're suing me cause i owned the building

    unreal......

                  I'm calling this lawyer tomorrow and telling him that if he doesn't drop me out of this in 5 days i'm going to the press and printing that he sues bankrupt people with no possibility of recovery to rip off his clients and collect fees and then see if anyone else ever hires him.

                                                                          I do not know Canada law...but I do think that in the states one being in bankruptcy would have any relevance. If the attorney won a law suit against you it could become collectable based upon future earnings for the next x number of years and then renewed for another x number of years etc. In addition a good attorney will sue anyone and everyone directly connected to an event or indirectly connected to an event to see what sticks to the wall and what doesn't. In example...a farmer was irrigating his crop with aluminum sprinkler pipe. The water sprayed onto a highway...and caused a car to lose control on the wet highway and the couple in the car sustained life long injuries. The farmer was sued...the outlet that sold the pipe to the farmer was sued...the manufacturer of the pipe was sued...the manufacturer of the sprinklers was sued...the county was sued (it was a county highway)...etc. If I remember correctly only the farmer was found to be liable...and of course he had insurance which for the most part covered the award...but not all of it.

I will say that even if you were not in bankruptcy I doubt that you...being the owner of the building...would be held liable for an event that involved a business/tenant in the building...but I do understand why the attorney would include you.

                                                                                      they would have a claim against the estate, but not my new life.

                                                                                                              I know some lawyers go with the attitude of suing anyone and everyone that is remotely connected to something in hopes that they will settle or that during discovery they will find some reason to put some of the blame on you.

                                                                                                              It's pretty fucked up, but like you said, you just rented the place to him, you can't be responsible for everything that goes on in there.

                                                                                                                      Bankruptcy gives one relief from one set of financial circumstances...but I find it difficult to believe that bankruptcy would relieve one of any and all liabilities. I am not an attorney and do not know the definitive law about this matter in the states...but my confidence level is high when I say that if it was in the states and one in fact was found to be liable for the business/tenants actions...I do not think that bankruptcy would be a defense to not having to pay on that liability as it is a different set of circumstance other than what the declaration of bankruptcy was based upon. I think a judgement would be brought against future earnings.

                                                                                                                                  Turn it over to your insurance company. Pretty simple. And if there is coverage and you are in BK, most attorneys will settle for the policy limits and leave you alone. For most attorneys it is not worth dealing with a defendant in BK. In the US, a BK will stay the proceedings.

Tenants and people try to sue landlords for any dumb shit they can come up with. Things you would laugh at but obviously its never a joke. An umbrella policy is actually a really good thing even if you don't have a lot of property but you want some extra protection.
