You might be... but it will depend. Usually most landlords have insurance that will over any civil liability for torts that happen on the premises.
Turn it over to your insurance company. Pretty simple. And if there is coverage and you are in BK, most attorneys will settle for the policy limits and leave you alone. For most attorneys it is not worth dealing with a defendant in BK. In the US, a BK will stay the proceedings.
