Those who produce these images will always find new ways to sell or expose them.. if not on the net, they will sell them elsewhere. Some states have domain names as property, others as contracts
There are 2 sets of laws as well in regards to stolen property or stolen contracts.
In california rulings domains have been ruled as property, thanks to sex.com case

For some bizarre reason, people don't think a TOS will hold up in court. I need to tell my HOA that and then paint the house, that I own, pink. Of course, the law has already STATED they can enforce that TOS even though there's no law in GA that says you can't paint a house pink AND has given them to right to fine me and put a lien on MY house that I OWN. Amazing.......

On a personal note, I find it amusing how many drama queens are now on GFY. Reminds me how much the industry has changed in 10 years.
It is also nice to see that I still have my groupies who want to try and bash me.... makes me feel wanted, warm and cuddly inside. Just what I need for the holidays.
Times are changing, the internet is no longer going to be the wild west it once was. Those who understand this and adapt will be successful, those who don't will be left behind ( or put in jail).

Fluid, because they were not asking for complete model information, and just the photo and the birthdate showing, they would likely not be in violation. Remember also that your models have to agree that their information can be shared with third parties for the purposes of your business, otherwise you likely cannot use the content (because you wouldn't be able to prove the model age to your processor, example).
Otherwise, there is would be no method by which you could run your business.Comment

My issue is only the the Registrant should be the OWNER and not that some registrant can handle your domain like they want. After reading today 2 hours the DirectNic TOS i think the only right the registrant/client has is to pay the overpriced yearly fee, nothing else. So everybody you wants to have INDEED OWNERSHIP over his domain should check out this french registar at http://www.gandi.net, site is in english and it's even cheaper than directNic and it's in France where Domains are property

Terms of Registrars
It is important to read a registrar's TOS carefully when selecting a domain name service provider, or when performing due diligence in connection with the sale of a business, or lending to a "dot com" business, or collecting on a judgment against a company using a domain name. If the current domain name registrar has unfavorable terms, the registrant can change registrars for a particular domain name. This may be advisable in such cases where the parties are looking for more robust rights in the domain name than available with the current registrar.
For instance, Gandi.net is an Internet domain name registration service located in Paris, France which expressly provides that the registrant "owns" the domain name. There is a useful online service called www.domainnamebuyersguide.com that rates the various Internet domain name registrars. The service rates Gandi.net with five stars (the highest rating) in the "Legal Ranking" category. Among the provisions set forth on gandi.net (at http://www.gandi.net/
faq.html.en visited on October 30, 2000) is the acknowledgment that the registrant "owns" the domain name provided registration fees are paid. The TOS for Gandi.net also provides that the registrant can change registrars at any time without any additional cost.
Another case bearing on the issue of whether a domain name qualifies as property is Kremen v. Cohen. 7 The case is interesting for three reasons: First, it was a dispute over who was master of the domain "sex.com". Plaintiff had alleged that the defendant had forged documents submitted to NSI pertaining to the transfer of the domain name to defendant.
Second, among other things, plaintiff alleged conversion of property. The Umbro court held that the domain name was intangible personal property. 8 The tort of conversion requires something tangible to facilitate the wrongful act of disposing of property. However, the court found that a domain name was not the type of intangible personal property that was associated with documents of title. Thus, the court granted summary judgment, dismissing the conversion claims. 9
Third, the court rejected the rationale of the Virginia Supreme Court in Umbro, and cited favorably the dissent, stating that the right to use domain names exists separate and apart from NSI's various services that make the domain names operational Internet addresses. These services are merely conditions subsequent, the court held. 10
Conclusion
It will be interesting to see how other courts around the country, indeed, around the world, will weigh-in on the issue of domain name ownership. The decisions will depend on the law of the jurisdictions in which the registrars are located and the terms of service agreements of the particular registrars, especially the provisions on ownership and assignability. Perhaps adducing proof as to the portability of domain names as between registrars, combined with the new express transfer provisions of NSI's TOS (version 5.1) will lead the next court to hold that domain names are a new form of intellectual property, capable of being "owned".

- even in the case you are right i would prefer a registar which admits to have NO rights on my domain and additionally to have the domains in a acountry where domains are the property of the owner or user, whatever you want.
- If you are right than i wonder how the court in the case sex.com decided it IS property. Maybe you want to re-read the conlclusions on some court decisions, just a suggestion ;-)
All i can say is that you can NOT show me 1 single argument why a registrar which DOESN NOT claim any rights (see gandy.net TOS) on your domain isn't better than a Registrar that claims ALL rights on your domains (see DirectNic TOS).
But by comparing the gandi.net TOS and the Directnic TOS i will show you about 183 reasons why i would choose gandi.net

Just again thought about your statement and i think you are wrong. My guess and opinion is that icann HAS to grant the countries and registars the rights accorging to their laws. The internet is and .com's are not exclusivly US, it's international and it makes only sense that the laws and TOS of where the Registar is settled take place. How i said, i have readed a lot the last days on icann too and i came neither across a point where icann grants the rights neither a point where icann doesn't grant the rights. How i said, doesn't matter at all, just a generally thought. Maybe i understand the agreement wrong, but for me it looks like that exactly the national laws for a registar take place.2.3 General Obligations of ICANN. With respect to all matters that impact the rights, obligations, or role of Registrar, ICANN shall during the Term of this Agreement:
2.3.3 not apply standards, policies, procedures or practices arbitrarily, unjustifiably, or inequitably and not single out Registrar for disparate treatment unless justified by substantial and reasonable cause
3.7.2 Registrar shall abide by applicable laws and governmental regulations.
3.7.7.10 For the adjudication of disputes concerning or arising from use of the Registered Name, the Registered Name Holder shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of the Registered Name Holder's domicile and (2) where Registrar is located.
Furthermore ICANN is located in California where we have already a court decission that Domains ARE PROPERTY!
So again, from what i see it's up to the registar and (inter)national and even state laws how they handle it. the 2 Law decissions in the US even proof that it's handled that way.
However, you avoided the other questions i made! What would be the advantate of a Registrar that claims he has ALL rights on YOUR domains against a Registrar that GIVES YOU ALL rights on your domain?

I said MANY TIMES if DirectNic cut them off w/o reason, then they deserve to be sued. But I'm sure you "anti-DirectNic - Pro someone who didn't even have an attorney" folks just passed right over those posts.
Reading Slick's posts, he seems like someone who didn't conduct his business as a business. He THINKS his links don't go to CP, he MIGHT have an attorney, he's come here FIRST everytime something's gone wrong, he didn't know who Intercosmos was even though it's on the electronic receipt, the verification email AND the credit card statement, etc.
Meanwhile DirectNic is own by attorneys and has several working for them and is a public company.

Directnic does not have the legal right to request documentation though, does it? I was only aware of the law giving those powers to the govt. If you have an issue with a site you report it to the authorities don't you? I don't see where Directnic has legal cause to request documentation. That violates more privacy laws cross-state and internationally too than I'm sure you're aware.

The registrar has a contract with the individual domain holder. That contract is drawn up in the area where the registrar is located.
None of this is news.
However, If ICANN grants rights ABCDEFG to the registrar for a domain name, by definition the regidstar cannot give HIJKLMNOP of their own will, because they don't have any more rights on those domain names than what was given in the contract with ICANN to start with that made them a registrar and allowed them to register domains.
That a country like France might consider a domain "property" might not mean much if ICANN revoked the rights of the french registrar, making all the registrations null and void, or transferring them to a registrar that wasn't in France.
It is, again, what I consider legal tiddlywinks. We all can play it until we are blue in the face, but at the end of the day, it doesn't apply in the slightest in this situation, because the registrar and the domain holder are both in the US and subject to US law, and court ruling on the subject pretty much seem to agree that the rights to a domain is an asset, but the domain itself isn't... because it cannot be owned, only leased, rented, or having the rights to do so transfered.
As Kimmy pointed out, it is pretty clear that ICANN has granted to Directnic (and every other registrar) the exact rights that they used to revoke or place on hold the domains in question.
I think that pretty much clears the whole thing up.Comment

We all can play it until we are blue in the face, but at the end of the day, it doesn't apply in the slightest in this situation, because the registrar and the domain holder are both in the US and subject to US law, and court ruling on the subject pretty much seem to agree that the rights to a domain is an asset, but the domain itself isn't... because it cannot be owned, only leased, rented, or having the rights to do so transfered.
As Kimmy pointed out, it is pretty clear that ICANN has granted to Directnic (and every other registrar) the exact rights that they used to revoke or place on hold the domains in question.
I think that pretty much clears the whole thing up.
i was talking generally and not only about us bases people and US registrars. I was very generally and in no way related to slick. All i'am doing or want to mention is that a registar like gandi.net which DOES NOT claim ANY RIGHTS to the domains give you FULL OWNERSHIP (at least as possible) to the domain holder.
I don't know why all statements are just reduced to the slick case when there are 1000's of other people around that are not aware that indeed DirectNic can nuke your domains/business/Sites nearly whenever they want due their TOS. So again, to my main question. What or why should/is the advantage of a Registrar that has 189 points in his TOS that he can nuke your domain whenever he feels like against a Registar who states in his TOS and Agreement that he has NO RIGHTS over your domain and it's your ownership??
If you don't get the point, or if i don't can explain and describe correctly, sorry than. But honestly, why would/should someone invest 10.000's, 100.000's or even millions in a business and be dependently to his registar and his mood? Sorry, but whatever business i would do (again talking generally, not only about adult) i always would choose the registar that gives ME most RIGHTS and also who has the LESS influence on my business/domains.
